• 0 <br />of any kind, and subject to all applicable laws, rules and ordinances governing their use, <br />occupancy and possession. <br />Tenant initials: <br />2. TERM OF LEASE & LICENSE: <br />The term of the Lease and the non-exclusive license to use the Licensed Premises are <br />concurrent and shall be two (2) years commencing October 1, 2015 (hereafter <br />"Commencement Date") and expiring September 30, 2017 (hereafter "Expiration Date") <br />3. RENT: Monthly Rent shall be $1,500.00 per month ($18,000.00 per year). <br />All sums payable by Tenant to Landlord hereunder shall be paid by good check to the <br />City of San Leandro, in care of Finance Director, City Hall, 835 East 14th Street, San <br />Leandro, California, 94577, or such other place as Landlord may designate in writing. <br />A. Late Charge: A late charge equivalent to six percent (6%) of any Rent, <br />or any portion of Rent, or any portion thereof due and unpaid for more than fifteen (15) <br />days, shall be paid by Tenant for each month that such Rent remains due and unpaid, <br />plus any attorneys' fees incurred by Landlord by reason of Tenant's failure to pay such <br />Rent. <br />B. IN-KIND SERVICES: In addition to Base Rent, as an independent <br />covenant of this Agreement Tenant shall make good faith efforts to be present and <br />monitor the Licensed Premises, including the opening and closing of the front gate, <br />commencing at 6:30 a.m. and ending at approximately 8 p.m. (Monday through Friday), <br />and from 7 a.m. to 6 p.m. (Saturday and Sunday). Closing of the gate may be earlier or <br />later by no more than 45 minutes depending upon the season and weather. Good faith <br />efforts shall include monitoring to discourage the establishment of encampments on the <br />Casa Peralta grounds and contacting Landlord's Public Works staff as needed for <br />plumbing, electrical, sewer, tree maintenance or other maintenance issues; and <br />contacting the San Leandro Police Department as necessary with regard to security <br />issues. Notwithstanding the foregoing, Tenant shall have no liability to Landlord for the <br />condition or security of the Licensed Premises and shall have no duty to insure the <br />Licensed Premises or to indemnify Landlord with regard thereto except as expressly set <br />forth elsewhere in this Agreement. Landlord's exclusive remedy for breach of this <br />provision shall be a monetary claim for damages equal to the amount that it costs <br />Landlord to provide the foregoing in kind services in the event Tenant is determined to <br />have breached its obligation to do so as set forth in this paragraph. <br />4. USE OF LEASED PREMISES AND LICENSED PREMISES <br />A. Permitted Use: Tenant's use shall be in accordance and <br />compliance with Federal, State, and City statutes, regulations, rules, and ordinances <br />existing at the commencement date, and enacted or approved thereafter. Tenant may <br />install a temporary storage shed upon the Licensed Premises, with Landlord's express <br />written permission, and approval of the design, color, and architecture of the storage <br />2 <br />
