ARTICLE 1 - DEFINITIONS <br />Unless otherwise indicated, the following terms shall have the following <br />meanings when used in this Declaration: <br />1.1 Act. “Act” means Sections 4000 through 6150, inclusive, of the Civil Code <br />of California, entitled “Davis-Stirling Common Interest Development Act,” as the same <br />may be amended from time to time. <br />1.2 Articles. “Articles” shall mean and refer to the Articles of Association of <br />the Association, as amended from time to time. <br />1.3 Assessments. “Assessment” means a charge levied by the Association <br />against an Owner and his or her Condominium in accordance with the provisions of this <br />Declaration. The specific types of Assessments are defined as follows: <br />(A)“Regular Assessment” means a charge levied against an Owner <br />and his or her Condominium for such Owner’s proportionate share of the Association’s <br />annual costs as provided in Article 12. <br />(B)“Special Assessment” means a charge levied against an Owner <br />and his or her Condominium for other purposes as provided in Article 12. <br />(C)“Reimbursement Assessment” means a charge levied against an <br />Owner and his or her Condominium as a fine or to repay or reimburse the Association <br />as provided in Section 12.11. <br />1.4 Association. “Association” shall mean and refer to 84 OAKES <br />BOULEVARD HOMEOWNERS’ ASSOCIATION, an unincorporated association, and its <br />successors and assigns. <br />1.5 Association Rules. “Association Rules” shall mean the rules adopted by <br />the Association as provided in Section 7.1(D). <br />1.6 Bylaws. “Bylaws” means the Association’s Bylaws and any amendments <br />which set forth procedural matters relating to the internal governance of the Project. <br />1.7 Common Area. “Common Area” means the entire Project except all Units <br />as defined in this Declaration and as shown on the Condominium Plan. <br />1.8 Condominium. “Condominium” means an estate in real property, as <br />defined in California Civil Code Section 4125, consisting of an undivided interest as a <br />tenant in common in all or any portion of the Common Area, together with a separate <br />fee interest in a Unit and any other separate interests in the real property as are <br />described in this Declaration, in the Condominium Plan, or in the deed conveying the <br />Condominium. <br />- CC&R'S - <br />84 Oakes Boulevard Condominiums <br />Printed: September 25, 2018 PAGE 2
