1.9 Condominium Plan. “Condominium Plan” means that certain <br />Condominium Plan prepared and recorded pursuant to Calif ornia Civil Code Section <br />4285 with respect to the Project, and any amendments to the Condominium Plan. The <br />Condominium Plan is attached hereto as Exhibit B. The execution of this Declaration <br />by Declarant or the execution of a subordination by any lender constitutes consent to <br />the recording of the Condominium Plan. <br />1.10 County. “County” means the County of Alameda, State of California. <br />1.11 Declarant. “Declarant” means RONGKANG WANG and any successor or <br />assign to whom Declarant assigns its interest as Declarant in whole or in part. <br />1.12 Declaration. “Declaration” means this Declaration of Covenants, <br />Conditions and Restrictions and any amendments or supplements hereto. <br />1.13 Eligible Insurer or Guarantor. “Eligible Insurer or Guarantor” means an <br />insurer or governmental guarantor of a first Mortgage who has requested notice of <br />certain matters from the Association pursuant to Section 16.5 of this Declaration. <br />1.14 Eligible Mortgage. “Eligible Mortgage” means a mortgage held by an <br />“Eligible Mortgagee”. <br />1.15 Eligible Mortgagee. “Eligible Mortgagee” means a first Mortgagee who <br />has requested notice of certain matters from the Association pursuant to Section 16.5 <br />of this Declaration. <br />1.16 Exclusive Use Common Area. “Exclusive Use Common Area” means that <br />portion of the Common Area that is reserved for the exclusive use of an Owner but <br />located outside the boundaries of that Owner’s Unit. The boundaries or location of and <br />limitations on the Exclusive Use Common Area are described in Section 4.3 and shown <br />on the Condominium Plan. <br />1.17 Governing Documents. “Governing Documents” is a collective term that <br />means and refers to this Declaration, the Bylaws, the Articles and to the Association <br />Rules. <br />1.18 Improvement. “Improvement” includes, without limitation, the physical <br />existence, construction, installation, alteration, or remodeling of any building, walls, <br />ceilings, floors and floor coverings, decks, appliances, fixtures, paint, framing, windows, <br />doors, fences, landscaping, landscaping structures, skylights, utility systems, or any <br />structure of any kind within the Project, including within the Units. <br />1.19 Insurance Trustee. “Insurance Trustee” means an institutional lender, <br />commercial escrow company or title company with trust powers in the County as may <br />be designated by the Association to hold and disburse funds as trustee for the <br />Association and the Owners, as provided in Section 13.1(A). <br />- CC&R'S - <br />84 Oakes Boulevard Condominiums <br />Printed: September 25, 2018 PAGE 3
