IIJ. ON-SITE IMPROVEMENTS <br />7. Applicant shall maintain access and internal circulation from the Williams Street entrance <br />through to other property owners and tenants on the parcel. <br />The parking spaces indicated on A095 Site Plan, for the use of the adult day care, shall be <br />maintained for this use as long as the day care use is in operation. <br />9. Applicant shall restripe and maintain the parking spaces provided as part of their lease. <br />EDA COUNTY DEPARTMENT OF ENVIRONMENTAL HEALTH A D <br />10. Due to the proximity of identified contaminant concentrations, unless otherwise rescinded in <br />writing by Alameda County Department of Environmental Health (ACDEH) and authorized by <br />the Zoning Enforcement Official, a vapor mitigation system shall be installed and operational <br />prior to building occupancy by the Applicant. <br />11. The Property Owner shall be responsible for conducting annual indoor air quality and sub -slab <br />vapor testing for the duration of the Applicant's tenancy and any subsequent General Day Care <br />facility operating at this location. A copy of the annual results shall be provided to the Alameda <br />County Department of Environmental Health (ACDEH), the City of San Leandro and the State <br />of California Department of Social Services Community Care Licensing Division. Should <br />conditions demonstrate, this requirement for annual testing may be modified or discontinued <br />upon prior formal written approval from both ACDEH and the Zoning Enforcement Official. <br />12. Additional mitigation measures may be required if indoor air quality and/or sub -slab vapor <br />testing is found to exceed acceptable levels as determined by ACDEH. <br />V. ENGINEERING & TRANSPORTATION DEPARTMENT REOUIREMENTS <br />13. Pursuant to Government Code Section 66020, including Section 66020 (d) (1), the City <br />HEREBY NOTIFIES the applicant for this Project that the 90 -day approval period (in which the <br />applicant may protest the imposition of any fees, dedications, reservations, or other exactions <br />imposed on this Project by these Conditions of Approval) will begin on the date of the <br />conditional approval of this Project. If the applicant fails to file a protest within this 90 -day <br />period, complying with all of the requirements of Government Code Section 66020, the <br />applicant will be legally barred from later challenging any such fees, dedications, reservations <br />or other exactions. <br />14. The proposed development shall comply with City ordinances, policies and regulations. All <br />improvements shall be in accordance with the City's Design Standards, Specifications and <br />Standard Plans unless otherwise specifically approved by the Principal Engineer. <br />15. Building Permit Plans shall include below notes: <br />a. The applicant shall obtain an Encroachment Permit from the Engineering and <br />Transportation Department for any work within the public right-of-way including the <br />use of lifting equipment or the staging of materials. Barricades, traffic cones, and/or <br />caution ribbon shall be positioned around any equipment or materials within the right- <br />of-way to provide a barrier to public access and assure public safety.
