File Number: 19-378 <br />Also at the June 6, 2019 hearing, the Planning Commission recommended City Council approval <br />of the proposed Tentative Tract Map to subdivide airspace within the approved building as a <br />condominium. Development of the project is not contingent upon City Council approval of the <br />proposed Tentative Tract Map. Approval of the map enables the project to be able to offer 26 <br />for-sale market rate condominiums, including 4 units set aside for inclusionary housing. In this <br />instance, since the Board of Zoning Adjustments previously approved the Site Plan Review and <br />Parking Exception for the development of the building, City Council action in this instance is <br />limited to the findings and conditions related to the proposed tentative tract map for condominium <br />purposes. <br />DETAILS OF THE PROJECT <br />The residential portion of the project includes 20 two-bedroom units and 6 one-bedroom units, <br />private decks, a 1,141 square foot private workout area, a social room, common office space, a <br />meeting room, dedicated bicycle storage room, a mail room, a 2,000 square foot outdoor <br />courtyard and grade level parking. The proposal also includes a ±2,400 square foot commercial <br />space along Washington Avenue. Mixed-use residential is permitted in the DA-1-Downtown <br />Mixed-Use Zoning District. Ground floor retail is required and provided along Washington <br />Avenue. <br />The ground floor parking garage is 10,459 square feet providing 26 standard parking spaces, 1 <br />accessible parking space, 3 motorcycle/scooter parking spaces and 18 bicycle spaces. Five <br />on-street parking spaces are also provided. The project complies with the Zoning Code’s parking <br />requirements for the residential use, but BZA approval of a Parking Exception was necessary to <br />accommodate the ground floor commercial space should it contain a tenant with higher parking <br />requirements, such as a restaurant. No particular tenant or use has been identified with the <br />project at this time. The Board of Zoning Adjustments approved a Parking Exception for the <br />±2,400 square foot ground floor commercial tenant space and placed scenario-specific <br />conditions of approval to accommodate uses such as a potential restaurant. <br />The applicant submitted a concurrent application for Tentative Tract Map 8476 to subdivide 268 <br />Parrott Street into a condominium. In this instance, the Zoning Code requires project approval by <br />the Board of Zoning Adjustments but the Subdivision Ordinance of the Municipal Code requires <br />Planning Commission recommendation and City Council approval of the proposed Tentative <br />Tract Map for condominium purposes. Development of the project as an apartment building is not <br />contingent upon approval of the proposed Tentative Tract Map. <br />STAFF ANALYSIS <br />Condominium Tentative Tract Map Approval - Per Section 7-1-330 of the San Leandro <br />Municipal Code, the Planning Commission’s recommendation of approval to City Council on <br />June 6 2019 was based on the development meeting the findings of fact and by establishing that: <br />·The design of the subdivision is consistent and applicable to the General / Specific Plans; <br />·The site is physically suitable for development and the proposed density; <br />·The proposed improvements will not cause substantial environmental damage <br />Page 3 City of San Leandro Printed on 7/9/2019 <br />31
