A consistency checklist is <br />prepared by a lead agency to streamline the environmental review process for eligible projects by <br />limiting the topics subject to review at the project level where the effects of development have <br />been addressed in a previous community plan. In accordance with CEQA Guidelines Section 15183, <br />if the project would result in new specific effects or more significant effects, and uniformly <br />applicable development policies or standards would not substantially mitigate such effects, those <br />effects are subject to CEQA. With respect to the effects that are subject to CEQA, the lead agency is <br />to prepare an Environmental Impact Report (EIR) if the written checklist shows that the effects of <br />the project would be potentially significant. <br />The checklist concludes that the project would not have significant effects on the environment that <br />either have not already been analyzed in a prior EIR or are more significant than previously <br />analyzed, or that uniformly applicable development policies would not substantially mitigate. <br />Pursuant to Public Resources Code Section 21094.5, such effects are exempt from further CEQA <br />review. <br />California Public Resources Code Section 21083.3 also limits the application of CEQA to effects on <br />the environment which are peculiar to the parcel or to the project and which were not addressed as <br />significant effects in the General Plan EIR, or which substantial new information shows will be more <br />significant than described in the General Plan EIR when projects are consistent with the <br />development density established by existing zoning, community plan or general plan policies for <br />which an EIR was certified (CEQA Guidelines, Section 15183[a], also Public Resources Code, Section <br />21083.3[b]: Exemption applies to “a development project [that] is consistent with the general plan <br />of a local agency [if] an environmental impact report was certified with respect to that general <br />plan). <br />This CEQA Guidelines Section 15183 Consistency Checklist has been prepared in accordance with <br />Public Resources Code Section 21000 et seq. and the CEQA Guidelines, California Code of <br />Regulations Section 15000 et seq. <br />
