<br /> 99 <br />I. No Short-Term Rental. ADUs and JADUs shall not be rented for terms of 30 days or <br />less. <br /> <br />J. Occupancy. Owner-occupancy shall not be required. <br /> <br />K. Sale. Neither an ADU nor JADU shall be sold separately from the primary structure. <br /> <br />L. Review and Approval Authority. Application for an ADU and/or JADU shall be subject to <br />ministerial building permit review and approval within 60 days of submission of a com- <br />plete application. However, if an application to create an ADU or JADU is submitted with <br />an application that requires discretionary review, a building permit shall not be issued <br />for the ADU or JADU until the discretionary approval(s) have first been granted and any <br />appeal period(s) has/have passed. <br /> <br />A. Definition. “Accessory dwelling unit” (ADU) means an attached or detached residential <br />dwelling unit which provides complete independent living facilities for one or more per- <br />sons. An ADU shall include permanent provisions for living, sleeping, eating, cooking, <br />and sanitation on the same parcel as the single-family dwelling is situated. An ADU <br />also includes: (a) an efficiency unit, as defined in Section 17958.1 of the California <br />Health and Safety Code; and (b) a manufactured home, as defined in Section 18007 of <br />the California Health and Safety Code. <br /> <br />B. Where Permitted. <br /> <br />1. ADUs shall be allowed in any residential zone where single-family homes, are per- <br />mitted, subject to meeting the regulations of this section. <br /> <br />2. An ADU may only be permitted where there is one principal residence on the lot. <br />In no case shall the number of dwelling units on the lot exceed two. ADUs are not <br />permitted in duplexes, triplexes, or other buildings with more than one principal <br />residence. <br /> <br />3. Additional dwelling units in the RO District are subject to Zoning Code provisions <br />for additional dwelling units in the RO District. <br /> <br />C. Ministerial Review and Approval Required. An ADU that meets the applicable locational <br />and development standards of this code shall be subject to ministerial review and ap- <br />proval. All permits shall be issued within 120 days of submission of a complete appli- <br />cation for ADUs conforming to the provisions of this section. <br /> <br />1. Application Requirements. Applicants for ADUs shall submit an application to the <br />Community Development Department, Planning Services Division, which, at a <br />minimum, shall include: <br /> <br />City Council Hearing March 2, 2020 137
