<br /> 105 <br />ADU. The Restriction shall include a prohibition on the sale of the ADU separate from <br />the sale of the principal residence and that the main dwelling or accessory dwelling <br />shall be owner-occupied, including a statement that the deed restriction may be en- <br />forced against future purchasers. <br /> <br />I. Prohibition—Subdivision—Separate Tax Assessment. Approval of an ADU shall not be <br />deemed to be a division of land for purposes of Government Code Section 66410 et <br />seq., or Title VII of the Municipal Code, nor shall the ministerial approval in accord with <br />this chapter entitle the applicant to: <br /> <br />1. Such a division of land; or <br /> <br />2. To have each of the two dwelling units on the parcel separately assessed for prop- <br />erty tax purposes. (Ord. 2017-003 § 4; Ord. 2012-013 § 3; Ord. 2003-010 § 1; Ord. <br />2001-015 § 1) <br /> <br />2.04.392 Manufactured Homes in R Districts <br /> <br />A. Purpose. It is the intent of the City to provide opportunities for the placement of manu- <br />factured homes in R districts, consistent with state law, and to ensure that such manu- <br />factured homes are designed and located so as to be harmonious within the context of <br />the surrounding houses and neighborhood. <br /> <br />B. General Requirements. Manufactured homes may be used for residential purposes if <br />such manufactured homes have been granted a Certificate of Compatibility and are <br />located in an R district. <br /> <br />C. Requirements for Certificates of Compatibility. Manufactured homes may be located in <br />any R district where a single-family detached dwelling is permitted, subject to the same <br />restrictions on density and to the same property development regulations, provided that <br />such manufactured home receives a Certificate of Compatibility. The Zoning Enforce- <br />ment Official shall issue a certificate of compatibility if the manufactured home complies <br />with all development regulations of the zoning district and if the Zoning Enforcement <br />Official determines that the manufactured home is compatible with surrounding devel- <br />opment. In considering compatibility, the Zoning Enforcement Official shall consider <br />only roof overhang, roofing material, siding material and roof design. <br /> <br />D. Cancellation of State Registration. Whenever a manufactured home is installed on a <br />permanent foundation, any registration of said manufactured home with the State of <br />California shall be canceled, pursuant to state laws and regulations. Before any occu- <br />pancy certificate may be issued for use of such a manufactured home, the owner shall <br />provide to the Building Official satisfactory evidence showing: that the state registration <br />of the manufactured home has been or will, with certainty, be canceled; if the manufac- <br />City Council Hearing March 2, 2020 143
