16 <br /> <br />would potentially remain significant and thus are subject to further environmental review in a full CEQA <br />review. <br />Incorrect Application of Water‐Related Operational Mitigation Measures <br />Review of the CalEEMod output files demonstrates that the “Callan and E 14th Street Infill Checklist <br />Project Operations” model includes the following water‐related operational mitigation measures (see <br />excerpt below) (Appendix A, pp. 179‐180): <br /> <br />As previously mentioned, the CalEEMod User’s Guide requires any changes to model defaults be <br />justified.28 However, the “User Entered Comments and Non‐Default Data” table fails to provide a <br />justification for inclusion of water‐related operational mitigation measures. Furthermore, the use of <br />low‐flow appliances and a water efficient irrigation system are not included as formal mitigation <br />measures in the Checklist. As such, we cannot guarantee that they would be implemented, monitored, <br />and enforced on the Project site. As a result, the inclusion of the above‐mentioned water‐related <br />operational mitigation measures in the model is incorrect. By including several unsubstantiated water‐ <br />related operational mitigation measures, the model may underestimate the Project’s water‐source <br />operational emissions and may constitute a significant impact that remains substantially unmitigated. <br />Diesel Particulate Matter Health Risk Emissions Inadequately Evaluated <br />The Checklist concludes that the proposed Project would result in a less‐than‐significant health risk <br />impact based on a quantified construction health risk analysis (“HRA”). Specifically, the Checklist <br />estimates that Project construction would result in a mitigated excess cancer risk of 4.9 in one million, <br />which would not exceed the BAAQMD threshold of 10 in one million (see excerpt below) (p. 4‐19, Table <br />4‐4). <br /> <br />28 CalEEMod User Guide, available at: http://www.caleemod.com/, p. 2, 9 <br />131
