Performance of the provisions of this agreement is subject to the <br />conditions and availability of funds as awarded by the State Librarian <br />under said Act. <br /> <br />42. Public Records Act: Material maintained or used by the California State Library is <br />considered “public record” under the Public Records Act (PRA) at Government <br />Code, sections 6250, et. seq. This includes the Interim and Final reports, and any <br />other written communications between the parties. Subrecipient agrees to <br />ensure that all content contained in its written reports are appropriate for <br />publication. Said material, along with all other reports, documentation and data <br />collected during the term of the Agreement, will be subject to disclosure unless it <br />qualifies for exemption under the PRA in whole or in part. Subrecipient agrees to <br />alert the State Library as to a basis for exemption, if any exists. <br /> <br />43. Publicity Obligations: Subrecipient will notify the State Library of any promotional <br />materials or publications resulting from the award no later than five (5) days in <br />advance of distribution, whether they are print, film, electronic, or in any other <br />format or medium. Copies of all promotional materials will be provided to the <br />State Library. Subrecipient will acknowledge the LSTA support as noted above. <br />Subrecipient agrees that the State Library may include information about this <br />grant and its outcomes in its own annual reports, with specific reference to <br />Subrecipient, and may distribute such information to third parties. <br /> <br />44. Records: Communications, grant related documents, data, original receipts and <br />invoices must be maintained by Subrecipient and shall be made available to the <br />State Library upon request. Subrecipient agrees to maintain adequate grant <br />program records and adequate financial records consistent with generally <br />accepted accounting practices, and to retain all records for at least five (5) <br />years after the end-of-term. The State Library may monitor or conduct an onsite <br />evaluation of Subrecipient’s operation to ensure compliance with this <br />Agreement, with reasonable advance notice. <br /> <br />45. Reduction of Waste: In the performance of this Agreement, Subrecipient shall <br />take all reasonable steps to ensure that materials purchased or utilized in the <br />course of the project are not wasted. Steps should include, but not be limited to: <br />the use of used, reusable, or recyclable products; discretion in the amount of <br />materials used; alternatives to disposal of materials consumed; and the practice <br />of other waste reduction measures where feasible and appropriate. <br /> <br />46.
