<br /> <br />4 <br />San Leandro Confidential EE Comp Plan January 1, 2022 – December 31, 2024 <br /> The setting of work hours is based upon the operational needs of the department. An <br />employee’s work hours may be changed based upon the operational needs of the <br />department. In the event an employee’s work schedule is to be changed, the employee shall <br />be given seven (7) working days advance notice. <br /> <br />Section 5. Overtime Compensation <br /> <br /> Except as otherwise noted, the City’s official work period is 12:00 a.m. Sunday through 11:59 <br />p.m. Saturday. Overtime is authorized time of five (5) minutes or more worked in excess of <br />forty (40) hours in a designated seven (7) day work period in the classification and/or in excess <br />of eight (8) hours (or the regularly scheduled work day if longer than (8) hours) in the <br />department in which the person is employed. Unless initiated/requested by an employee, no <br />employee's scheduled work period will be changed to avoid paying overtime. <br /> <br /> When first authorized by the department head and with approval of the City Manager, <br />overtime worked shall be paid at the rate of one and one-half (1½) times the hourly rate based <br />on the employee's monthly salary. For required call-out on a normal work day, a minimum <br />two (2) hours' pay at the overtime rate will be paid for the first such call-out. For required call- <br />out on a normal day off, a minimum two (2) hours' pay at the overtime rate will be paid for <br />each of the first two (2) such call-outs. It is understood that a telephone call made to an <br />employee during non-working hours which does not result in a call-out of that employee, shall <br />not qualify for payment pursuant to this section. This time off must be taken no later than the <br />calendar year following the calendar year in which it was accrued and at a time specifically <br />approved by the supervisor. Except as herein above, a full-time regular employee who is <br />required to work on a holiday at the direction of their department head, shall receive their pay <br />for the holiday plus one and one-half (1½) times their regular pay for the time worked. <br /> <br /> An employee may elect to take compensatory time off in an amount equal to one and one- <br />half (1½) times the overtime worked in lieu of pay. Compensatory time may be used, and <br />replaced, without regard to frequency of use, as long as the account balance does not exceed <br />80 hours. <br /> <br /> In the event an employee is ordered by a magistrate to appear in court and does appear on <br />a day during which the employee has called in sick, the employee will be paid overtime at the <br />rate listed for court appearance, except that employees working the day shift shall not be paid <br />overtime, but the hours spent at the court appearance shall not be deducted from their <br />accumulated sick leave hours. <br /> <br />Upon promotion out of the Confidential group or other movement to a different employee <br />group or bargaining unit within the City, any unused, accrued time or comp time remaining in <br />the employee’s leave bank/s shall be paid off at the rate of pay which immediately preceded <br />the promotion or reassignment. <br /> <br />Section 6. Application of Pay Rates <br /> <br /> Employees shall be paid a salary or hourly rate within the range established for that <br />classification under the City pay plan. Employees reinstated or reemployed after layoff shall <br />receive a pay rate within the pay range established for the class to which they are assigned. <br />
