A consistency checklist <br />may be prepared by a lead agency to streamline the environmental review process for eligible <br />projects by limiting the topics subject to review at the project level where the effects of <br />development have been addressed in a previous Environmental Impact Report (EIR). In accordance <br />with CEQA Guidelines Section 15183, if the project would result in new specific effects or more <br />significant effects, and uniformly applicable development policies or standards would not <br />substantially mitigate such effects, those effects are subject to CEQA. With respect to the effects <br />that are subject to CEQA, the lead agency is to prepare a Mitigated Negative Declaration or EIR if the <br />written checklist shows the effects of the infill project would be potentially significant. <br />The checklist concludes that the project would not have significant effects on the environment that <br />either have not been analyzed in a prior EIR or are more significant than previously analyzed, or that <br />uniformly applicable development policies would not substantially mitigate. Pursuant to Public <br />Resources Code (PRC) Section 21094.5, such effects are exempt from further CEQA review. <br />California PRC Section 21083.3 also limits the application of CEQA to effects on the environment <br />peculiar to the parcel or to the project and that were not addressed as significant effects in the prior <br />environmental impact report, or about which substantial new information shows will be more <br />significant than described in the prior EIR, when projects are consistent with the development <br />density established by existing zoning, community plan, or general plan policies for which an EIR was <br />certified (CEQA Guidelines Section 15183[a], also PRC Section 21083.3[b]). <br />This CEQA Guidelines Section 15183 Consistency Checklist has been prepared in accordance with <br />PRC Section 21000 et seq. and the CEQA Guidelines, California Code of Regulations Section 15000 et <br />seq. <br />Anne Wong Associate Planner <br />3/16/2022
