That the amendment at the not to exceed amount of $150,000.00 is approved and the <br />City Manager is authorized to execute Amendment No. 1 to the Consultant Services <br />Agreement with SWCA Environmental Consultants for On-Call Planning Services to <br />be provided on an as-needed basis; and <br />2. That the firm will be compensated for their work through a deposit paid to the City by <br />project applicants; and <br />3. That the firm will provide planning and staffing services on behalf of the City of San <br />Leandro; and <br />4. That an appropriation of $150,000 for Fiscal Year 2021-22 from the General Fund <br />Undesignated Fund Balance into Account 010-41-001-5120 to cover this contractual <br />obligation is hereby authorized; <br />5. That the Fiscal Year 2022-23 budget will be increased by the balance of $150,000, <br />less any direct expenditures incurred for this project, that remains at the close of <br />Fiscal Year 2021-22; and that the exact project balance, as determined by the <br />Finance Department, shall be appropriated into Account 010-41-001-5120 for Fiscal <br />Year 2022-23; <br />6. That the City Manager or her designee is hereby authorized to negotiate and approve <br />cumulative amendments to the agreement up to a maximum of 25% of the amended <br />contract amount provided that the amended amounts are available in the project <br />deposit account; and <br />7. That the City Manager is authorized to make non-substantial revisions to said <br />agreement amendment, subject to the approval of the City Attorney; and <br />8.
