•- \ i i i/�i � •y+ <br />acceptable levels until sometime after year 2006 and before year 2025, when the <br />DavislDoolittle intersection mitigation measures are employed, a significant relief of <br />traffic congestion will be realized (LOS F to LOS D in 2025) reducing delay by <br />almost 50%. Similar improvements can also be realized with the project in year 2006 <br />with over a 40% reduction in delay from delay levels without mitigation. Therefore, <br />the Subdivider/Developer proposes a, more immediate solution to relieve traffic <br />congestion in the area as follows: <br />a. The Subdivider shall advance the total costs of improvements <br />(including right-of-way acquisition, design and construction) <br />required at the intersection of Davis Street and Doolittle Drive <br />(Options 1 & 2 combined) identified subsequent to the Traffic Study. <br />The extent of these improvements and alternative must be approved <br />by the Engineering and Transportation Department and Caltrans. <br />The preliminary construction cost estimate for required <br />improvements (Option 1 &2 combined) for Davis Street and Doolittle <br />Drive intersection prepared by Engineering and Transportation <br />Department dated July 30, 2002 is approximately $872, 000. The <br />improvements in Option 1 & 2 shall include but are not limited to <br />additions of Davis Street eastbound right turn lane, Davis Street <br />westbound right turn lane, and Doolittle Drive northbound right turn <br />lane; median modifications; new striping; demolitions of existing <br />improvements; right of way acquisition; and a new 8-phase traffic <br />signal. 15% of the improvement costs shall be the ultimate <br />responsibility of the Subdivider and shall not be reimbursable. The <br />remaining 85% of total improvement costs shall be reimbursed to the <br />Subdivider through the establishment of traffic impact fees for the <br />area. The details and mechanism for these traffic. impact fees shall <br />be determined by staff and presented to the City Council at a date <br />subsequent to the approval of the Subdivision, for consideration and <br />approval. Traffic impact fees collected by the City shall be <br />forwarded to the Subdivider as credit for the Developer's 85% <br />reimbursable contribution. At the end of five years, after Council's <br />initial acceptance of the subdivision, City agrees to reimburse the <br />Subdivider the difference .between 85% of the total improvement <br />costs and all collected traffic impact fees for the intersection <br />improvements. This reimbursement shall represent improvement <br />costs which are not attributable to the Subdivider's development. <br />Subdivider shall work with staff to assiduously pursue all possible <br />legal means to assure the most timely completion of the Intersection <br />Improvement Project. The design for such improvements shall be <br />completed and approved by the City and Caltrans prior to the <br />issuance of the first certificate of occupancy for the development. <br />b. Notwithstanding the foregoing the Developer shall, promptly, upon <br />approval of the proposed subdivision and development by City <br />
