/tZAOKT C Council, develop a Signal Timing Plan for the signals on Davis Street between 1-880 Northbound Ramp to Doolittle Drive, to be reviewed and approved by the City and Caltrans. The costs for the preparation and implementation of the Signal Timing Plan shall be fully borne by the Subdivider. Implementation of the Signal Timing Plan shall be completed prior to issuance of the first certificate of occupancy for the development. C. The Traffic Study indicates that four (4) percent of the project's traffic would use the proposed connection of Eden road between Davis and Doolittle '(Eden Road Project). Therefore, Subdivider shall pay four (4) percent (fair share) contribution for the estimated construction costs of acquisition of property and construction of _ Eden Road between Doolittle Drive and Davis Street. The preliminary construction cost estimated for Eden Road prepared by Engineering and Transportation Department dated February 4, 2002 is approximately $5.0 million. The project cost estimate shall be adjusted based on Engineering News Record (ENR), Construction Cost Index considering First Quarter 2002, as base year with index value of 6501.69 published in ENR. The pro-rata share of costs for each lot based on square footage (considering 8 lots total) shall be assessed at such time as the City has established the funding of the balance of the Eden Road Project cost through an assessment district or other such public improvement financing vehicle. Each of the 8 lots will contain an affirmative covenant agreeing to the establishment of such an assessment district or other such financing vehicle if established. d. The Traffic Study recommending addition of westbound left turn lane to provide access to the site. This will require striping modifications or other improvements necessary on. Davis Street to accommodate addition of the left turn lane. All of these improvements shall be constructed or must be included in the Subdivision Improvements T Agreement prior to the Final Map. e. Developer shall contribute to LINKS program (shuttle bus) administered by the San Leandro Transit Management Organization. The contribution amount, year when annual payment commences, and terms of payment shall be determined by mutual agreement between the developer and the City of San Leandro prior to approval of the Final Map.
