f. Post a $10,000 performance deposit and a $10,000 maintenance deposit with the City <br />Engineer. The City Engineer is authorized to release the performance deposit upon full <br />compliance with all conditions of the Conditional Use Permit. The maintenance deposit <br />shall be retained by the City for the full term of operation of this use of the property. The <br />The City Engineer is authorized to waive or modify this requirement upon determination <br />that the applicant has demonstrated a consistent ability to comply with the Conditional <br />Use Permit and all City regulations. <br />g. Install "No Dumping" signs on Eden Road. The locations and the wording of the signs <br />to be approved by staff". <br />h. Remove the following conditions which are no longer applicable to the operation: <br />I.A. Regarding compliance wihth Exhibits. The exhibits are no longer applicable. <br />III.A. Regarding the repair of existing fencing on the site. Existing fencing has been <br />repaired. <br />III.B. Regarding standards for the Eden Road fence. The fence has been refurbished to <br />a standard approved by the Planning staff. <br />III.C. Regarding refurbishment of the buildings on the site. This condition was added <br />because it was anticipated that customers would come to the site. Customers do <br />not come to the site, therefore, this requirement is not necessary. <br />III.D. Requiring a customer parking area. This condition is unnecessary as the <br />business does not have customer traff c, except for delivery and loading of trucks <br />on the site. <br />IV.E. Requiring the removal of equipment and debris from the site prior to <br />commencement of operation. This condition has been complied with. <br />V.D. Requiring a six month review of the permit for noise, dust and debris on the site. <br />To date, the City has not received complaints or observed problems related to <br />noise, dust or debris. <br />3. If the site is not in full conformance with all requirements of the Conditional Use Permit <br />by October 15, 1996, the permit will be revoked and the business owner will be required _ <br />to immediate]-,,- cease all activity on the site.
