V. GENERAL CONDITIONS A. The applicant shall pursue with the City the use of reclaimed water from the Waste Water Treatment Plant for dust control on the site and on Eden Road. B. The approval granted by the City as a result of this application, as well as the Conditions of Approval, shall be recorded in the office of the County_ Recorder of Alameda County. G.F. No application for amendment of the application or Conditions of Approval may be submitted or accepted for processing by the City unless (i) there is full compliance with all terms of the application and Conditions of Approval; or (ii) the Development Services Director waives compliance with the terms of the application and Conditions of Approval pending application for amendment. G. Post a 510,000 performance deposit and a 510,000 maintenance deposit with the City Engineer. The maintenance deposit shall be retained by the City for the full term of operation of this use of the property. The City Engineer is authorized to waive or modify this requirement upon determination that the applicant has demonstrated a consistent ability to comply with the Conditional Use Permit and all City regulations.
