Starting back in 1995, City <br />Community Standards Officers were in contact (in person and via letter and telephone calls) with <br />Mr. Jerry Guss, regarding possible violations of the use permit issued in 1993 (see attached). Due <br />to outstanding issues of non-compliance with the use permit, the Board of Zoning Adjustments <br />yoked the use permit on August 1, 1996. This decision was appealed by Mr. Guss to the City <br />)until, who on October 21, 1996 granted a six-month extension for compliance with the <br />.,.,nditions of the use permit: The last record of correspondence found in our files indicates that C <br />& G had achieved some, but not all of the conditions (see attached letter, dated January 8, 1997). <br />As indicated in our meeting, the City recently was made aware of the fact that the stockpiled <br />material was in excess of 15 feet in height, which is a violation of the use permit. After a field <br />reconnaissance of the property on August 29, 2001 by myself and Mr. Keith Cooke, Senior <br />Engineer, we ascertained that the stockpile was indeed in excess of the maximum 15-foot height <br />and that the stockpile also contained a large amount of dirt. The use permit clearly stipulates that <br />the permit is for the recycling of asphalt and concrete only. In order to bring dirt onto the <br />property, a modification to the use permit would need to be processed. <br />In order to meet Engineering Department standii <br />ards for this operation and to bring the use into <br />compliance with the issued use permit, the following tasks would need to be completed by C & <br />G Contractors, on a time frame approved by the Engineering Departments (please see the <br />January 8, 1997 for additional information): <br />1. Submit grading plans and apply for a Grading Permit, along with the reduced $2,500. . <br />deposit for warranty and inspection of the work to be performed.
