3. The property subject to the rezone will be served by streets, utilities and other public <br />facilities of sufficient capacity to properly serve it without overloading and without <br />detriment to other areas presently zoned in contemplation of full use and availability of <br />such facilities. <br />As part of the comprehensive plan to rezone and redevelop the subject property, the subject <br />property and the area will be improved with adequate public infrastructure such as a street <br />for access (proposed as private), utilities and other public facilities to properly serve it <br />without overloading and without detriment to the immediate area. Additionally, the <br />developer will be contributing to required off -site traffic mitigation measures. The project <br />has been engineered to address the site's flood plain status. All public and private <br />improvements shall meet City and other discretionary agencies requirements for <br />development. <br />Planned Unit Development <br />1. That the proposed location of the use is in accord with the objectives of the Zoning <br />Code and the purposes of the district in which the site is located. <br />The proposed location, with the approval of the rezoning from IG District to IG (PD) <br />District, will result in development of an industrial business park in an existing industrial <br />part of the city. The requirement to limit the amount of non -ancillary office space on -site <br />will provide control of the project's impact on the local roadway system. In addition, the <br />proposal to eliminate certain permitted and conditionally permitted IG uses will ensure that <br />the development will remain high quality and will not adversely impact nearby uses. <br />2. That the proposed location of the use and the proposed conditions under which it <br />would be operated or maintained, will be consistent with the General Plan; will not be <br />detrimental to the public health, safety or welfare of persons residing or working in or <br />adjacent to the neighborhood of such use; and will not be detrimental to properties or <br />improvements in the vicinity or to the general welfare of the City. <br />The proposal is consistent with City goals, objectives and policies related to several land use <br />and circulation policies/actions outlined in the General Plan (as specifically noted above). <br />The development will result in an improvement in appearance to the property with the <br />removal of the existing structures on the property and the subsequent redevelopment of the <br />property with a new industrial business park. Both a Phase I and Phase II Environmental <br />Assessment have been performed for the project site, with only minimal contaminations <br />found. Any lead/asbestos contained in existing buildings will be properly remediated and <br />disposed of during the demolition phase. The new business park has been designed, and will <br />be constructed and equipped to provide an adequate level of safety and security for the <br />future occupants. The site will be adequately served with public services, including utilities, <br />and public transportation. The application of current construction practices will prevent <br />disturbances from significant levels of noise emanating from within the completed <br />buildings.
