East 10 Street South Area <br />Interim Urgency Ordinance and Development Strategy <br />December 17, 2001 <br />Page 3 of 7 <br />Area Redevelopment Advisory Committee, the Planning Commission, the Board of <br />Zoning Adjustments, as well as local homeowner associations and the Business <br />Association of South San Leandro. This public outreach process would provide the <br />basis for reaching community consensus on development concepts and <br />implementation strategies. Ultimately, the draft Strategy would be presented to the <br />City Council/Redevelopment Agency for adoption. <br />• The estimated timeline for this study is presented in the Attachment 1: Conceptual <br />Work Program. The goal is to complete the study within one year. <br />Interim Ordinance <br />• The proposed Interim Urgency Ordinance would give staff additional discretionary <br />review over the project area during the time that the Development Strategy is being <br />prepared. Once the Strategy is adopted, the Urgency Ordinance would become null <br />and void. <br />Government Code Section 65858 provides for adoption (by four -fifths vote) of an <br />interim urgency ordinance for a period of 45 days. The City Council may also extend <br />the interim ordinance (by four -fifths vote) for a maximum period of 22 months and 15 <br />days through a noticed public hearing. In the past, the City Council has enacted three <br />interim ordinances for moratoriums on check cashing/advance paycheck businesses, <br />cigarette stores, and large homes and additions in the Bay-O-Vista area. <br />The public hearing for an extension of this urgency interim ordinance would be <br />tentatively scheduled for a City Council meeting in January 2002. A time frame of <br />one year would allow staff to complete any zoning code amendments anticipated to <br />be part of the Strategy's recommendations and have them reviewed and adopted by <br />the City Council. <br />Staff is recommending that the ordinance be applicable to business licenses and <br />development proposals within the East 14th Street South Area that: <br />➢ involve a change in use including, but not limited to, substitution of one permitted <br />use with another permitted use in the applicable zoning district; or <br />➢ do not meet parking requirements as defined in the Zoning Code; or <br />➢ intensify existing uses that may result in increases in noise, traffic, number of <br />employees, or other similar impacts; or <br />➢ establish, increase, or change business hours beyond the period of 7 am to 10 pm. <br />Staff recommends that this discretionary review include any pending development <br />applications and zoning permits. Staff further recommends that applications that have <br />already received entitlement, but may not be under operation, be exempt from the <br />ordinance. <br />
