City Council Staff Report February 9, 1999 <br />General Plan Amendment; A-98-8; PD-98-2; TM 7078 Page 5 of 12 <br />• At least one-third of the housing in Neighborhoods A and B have garage setbacks of significant <br />proportion; <br />• Lot Number 114 be eliminated and the park area be enlarged in that area; <br />• A landscaped pedestrian access be provided between Lot Numbers 4 and 5. <br />The Commission felt the garage doors needed additional setback for variation as a positive, visual <br />enhancement to the subdivision and to correspond to the predominant theme in the nearby <br />neighborhoods. The removal of Lot 114 would create a view of the park or open space from the <br />street intersecting it rather than a view of a home. A pedestrian way between Lots 4 and 5 will <br />connect the Peralta cul-de-sac with the cul-de-sac coming off of the Alvarado Street extension. The <br />site plan and Vesting Tentative Map attached to this report have already been revised to show the <br />second and third requirement described above. The park has been enlarged so the view in a <br />southwesterly direction on `Street B' will be of the park and not a home. The Peralta Avenue cul- <br />de-sac has been connected to `Street M' via a pedestrian way. <br />ENVIRONMENTAL REVIEW <br />This project has been reviewed pursuant to the California Environmental Quality Act. The Initial <br />Study concluded that, with the required mitigation measures, the General Plan Amendment, the <br />rezoning, the Planned Development, and the Vesting Tentative Map will not have a significant <br />impact on the environment. A Mitigated Negative Declaration has been prepared. The required <br />30-day review period was October 7, 1998 to November 6, 1998. Staff has prepared a response <br />to the comments received regarding the Initial Study and the Mitigated Negative Declaration. <br />The Planning Commission and Staff recommend the City Council adopt the Mitigated Negative <br />Declaration. A copy of the Mitigated Negative Declaration, Initial Study, and response to <br />comments is attached. <br />The noise impacts have been addressed and have been discussed in the Initial Study <br />accompanying the Mitigated Negative Declaration. The study includes recommendations in <br />reducing noise exposures in outdoor and indoor areas. To reduce outdoor noise, a 12-foot <br />soundwall is recommended along the westerly edge of the subdivision and a graduated soundwall <br />ranging from 10 feet to six feet is recommended for the northerly end of the subdivision. There <br />are no outdoor use areas; i.e., backyards facing BART. The combination of the distance of the <br />outdoor use area from BART and the placement of the homes themselves will reduce noise levels <br />along the easterly edge. There are two rear yards facing the easterly edge that require some <br />additional soundwall treatment. A 12-foot soundwall will be constructed along the easterly edge <br />for additional noise attenuation and to maintain the quality appearance of the development. To <br />reduce interior noise levels, dual -pane windows and sound insulation in the walls will be <br />required. <br />The recommended, noise -mitigation measures will bring the outdoor noise levels to a <br />conditionally acceptable level of 65dB as specified in the Noise Element of the General Plan. <br />As for other highlights in the Mitigated Negative Declaration, grading and drainage plans will be <br />monitored by the Engineering and Transportation Department.
