PD-98-2 & Vesting Tentative Map Tract No.7078 Page 3 of 22 <br />Recommended Conditions of Approval February 9, 1999 <br />actual costs may be based upon the standard fee schedule for such <br />purposes. Should the City or other governmental agency be unable to <br />sufficiently staff such responsibilities it may, at its discretion, retain <br />outside services which shall be paid for by the developer based upon <br />invoices received. <br />III. PERMITTED USE <br />A. This Planned Development and Vesting Tentative Map is an approval to <br />construct a 354-unit single family home, duet and courtyard home <br />subdivision in the 44.6 acre area bounded by the BART right-of-way to <br />the east, the San Leandro Creek to the south, the Southern Pacific Railroad <br />right-of-way to the west, and the San Leandro -Oakland border to the <br />north. Assessor's Parcel Numbers 75-155-1-2, 2-2, 2-8, 2-11, 2-12, 4, 75- <br />207-1, 3-1,4-1, 5-1,6-1, 6-4, 7-1, 7-2, 7-3, and 8-2. <br />B. Construction of the project shall remain in substantial compliance with the <br />approved exhibits and plans. Any change to the project design, materials <br />or colors shall be subject to the review and approval of the Development <br />Services Director who may administratively approve or require review by <br />the Planning Commission and City Council as a modification to the <br />Planned Development. <br />IV. PROJECT SITE IMPROVEMENTS <br />A. All garage doors shall be a roll -up sectional type. <br />B. All garages shall have electronic, remote control garage door openers. <br />C. The minimum distance between the garage door and the inside edge of the <br />sidewalk shall be 18 feet, details subject to approval of the Development <br />Services Director. <br />D. An average of two 15-gallon trees per lot shall be planted within the <br />subdivision. <br />E. Within the habitable areas of the dwellings, exterior sound transmission <br />control measures shall be provided to prevent the intrusion of exterior <br />noise. Interior noise levels attributable to exterior sources shall not exceed <br />45 dBA in any habitable room. <br />F. Prior to approval of the final building plans for building permits, the <br />developer shall submit evidence that all residences comply with Title 24 <br />Code, to the satisfaction of the Chief Building Official. <br />
