A-98-9/PD-98-3 Trumark - 5 - <br />July 14, 1999 <br />■ The Commission felt the park should be relocated to the bend in Road B. It would be more <br />centrally located in the project and would result in a better location for the unit placed in the <br />former park location. It also results in two units no longer abutting the service center <br />property. <br />■ There should be a comprehensive disclosure statement signed by each homebuyer revealing <br />to buyers the noise and traffic associated with the surrounding land uses. This would help <br />avoid complaints coming back to the City in the future. The items to be disclosed would <br />include truck hours in the Service Center, the railroad tracks and the adjacent shopping <br />center. <br />■ Sidewalk should be added to one side of Road C to be in conformance with the other roads in <br />the development. <br />■ There should be a restriction in the Conditions, Covenants and Restrictions (CC&R's) that <br />the parking spaces within the garages be available for vehicle parking at all times and not be <br />used for storage. <br />■ Stone treatment should be added to both sides of the garages in Plans 6 and 7. <br />DISCUSSION <br />Inclusionary Housing <br />The project is located within the Joint City and Alameda County Redevelopment Project Area. <br />Residential development within redevelopment project area has an Inclusionary Housing <br />requirement in which a portion of the housing project must be affordable to low- and moderate - <br />income families. As mandated by State Redevelopment Law, the applicant has agreed to provide <br />15% (10) of the dwelling units as inclusionary housing. <br />ENVIRONMENTAL REVIEW <br />This project has been reviewed pursuant to the California Environmental Quality Act. The Initial <br />Study concluded that, with the required mitigation measures, the rezoning, Planned Development <br />and Vesting Tentative Maps would not have a significant impact on the environment. A <br />Mitigated Negative Declaration has been prepared (see attached). The Planning Commission and <br />Staff recommend the City Council adopt the Mitigated Negative Declaration. <br />Vesting Tentative Maps <br />These Findings have been drafted into a Resolution for the Council's consideration: <br />1. The proposed map will be consistent with the General Plan and applicable specific <br />plans in that it provides for lower -density residential use in an area with some older <br />residential and commercial development. <br />t <br />
