City of San Leandro <br />2023-2031 Housing Element Update <br /> <br />3-32 <br />(5) Potential impact on surrounding uses. <br />(6) Physical attributes of the property and structures. <br />(7) Alternative reasonable accommodations which may provide an equivalent level of benefit. <br />In granting a request for reasonable accommodation, the reviewing authority may impose any <br />conditions of approval deemed reasonable and necessary to ensure that the reasonable <br />accommodation would comply with the findings required above. <br />Appeal of Determination <br />A determination by the reviewing authority to grant or deny a request for reasonable <br />accommodation for land use may be appealed to the Planning Commission. <br />A request for reasonable accommodation may include a modification or exception to the rules, <br />standards and practices for the siting, development and use of housing or housing-related <br />facilities that would eliminate regulatory barriers and provide a person with a disability equal <br />opportunity to housing of his/her choice. Requests for reasonable accommodation shall be <br />made in the manner prescribed by §2.5.310 (Application Requirements) and shall be made to <br />the City’s ADA Coordinator. <br />Requests for all special accommodations or to file grievances with the City regarding the City’s <br />failure to provide a reasonable accommodation can be submitted to the City’s ADA Coordinator or <br />Section 504 Coordinator. The contact information for these individuals can be found on the policy <br />form. However, while the policy information form is located on the City’s website, it is not easily <br />accessible. The City will review the City’s adopted 2009 reasonable accommodation policy and <br />grievance procedure, update as needed, and provide a link to its Reasonable Accommodations <br />policy on the Housing page of the City website, as described in Program 15 of Chapter 6, Housing <br />Plan. <br />California Building Code <br />San Leandro adopted and amended the California Building Code (CBC), 2019 Edition. The CBC <br />contains general building design and construction requirements relating to fire and life safety, <br />structural safety, and access compliance. The guidelines established by the CBC provide minimum <br />standards to safeguard life or limb, health, property, and public welfare by regulating and <br />controlling the design, construction, quality of materials, use and occupancy, location and <br />maintenance of all buildings and structures and certain equipment. The City’s Building & Safety <br />Services Division ensures that new construction and structural improvements in San Leandro are <br />executed safely and in compliance with the CBC.22 <br />San Leandro adopted local amendments to the CBC to address earthquake design standards within <br />San Leandro. The City has not adopted unique restrictions that would constrain the development of <br />housing for persons with disabilities. Compliance with provisions of the Code of Regulations, <br />California Building Standards Code and Federal Americans with Disabilities Act (ADA) is assessed and <br />enforced by the Building and Safety Division of the Community Development Department as part of <br />the plan check and building permit issuance process.
