717��497 90' 01 L�1) <br />5. ENFORCEMENT OF THIS AGREEMENT: <br />a. The terms and conditions of this agreement <br />are enforceable by deed restrictions running <br />with the land on which this project is <br />located, for a period of fifteen (15) years <br />from the date of the execution of this <br />agreement, which date shall be the same date <br />as the execution date of the Regulatory <br />Agreement for said property. <br />b. REMEDIES IF ASSISTED UNITS FAIL TO REMAIN <br />AFFORDABLE: If the HOME assisted units fail <br />to remain affordable, as defined in 24 CFR <br />Part 92.252, for the entire term of this <br />agreement, the LENDER may take one or more of <br />the following actions: <br />1. Require payment of the outstanding <br />amount of the loan, including interest <br />due and the prepayment penalty set forth <br />in the Promissory Note. <br />2. Institute foreclosure proceedings in <br />accordance with the Subordinate Deed of <br />Trust, the Regulatory Agreement and the <br />9/28/93 (STM) 7 <br />
