Plan Check comments from the City shall be incorporated into the Project Manual and <br />Drawings as necessary to obtain a building permit. <br />4. Review comments from the City shall be incorporated into the Project Manual and <br />Drawings prior to submission for bid. <br />A fixed limit of construction cost shall be established by the Design Development Phase <br />cost estimate prepared by the City. In the event that the fixed limit of construction cost <br />is exceeded by more than ten percent (10%) by the Construction Document Phase cost <br />estimate prepared by the City the City shall: <br />a. give written approval of an increase in such fixed limits; or <br />b. cooperate in revising the Project scope and quality as required to reduce the <br />Construction Documents Phase cost estimate. <br />If the City chooses to proceed based on the item (b) the Contractor, without additional <br />charge, shall modify the contract documents as necessary to result in a Construction <br />Documents Phase cost estimate which is not greater than the fixed limit of construction <br />cost plus ten percent (10%). The modification of Contract Documents shall be the limit <br />of the Contractor's responsibility arising out of the establishment of a fixed limit. <br />PHASE THREE <br />BIDDING: <br />Scope of Basic Services <br />The services provided during this phase shall generally be intended to assist the City construction <br />manager obtain bids for the Project. The services to be provided shall include the following: <br />Research, prepare and distribute addenda during the Bidding phase, including the <br />preparation of supplementary drawings, specifications, instructions and notices, as may be <br />necessary to inform bidders of changes in the bidding schedules and procedures and <br />changes or clarification of the specifications and drawings. <br />A. Corrections and clarifications of the Contract Documents and research and <br />preparation of supplementary drawings, specifications, instructions and notices <br />related to addenda caused to be distributed by the Contractor shall be provided <br />as a basic service and no additional compensation shall be paid to the Contractor <br />on account of providing the services. <br />B. Research and preparation of supplementary drawings, specifications, instructions <br />and notices related to addenda caused to be distributed by the City shall be <br />provided as an extra or additional service and additional compensation shall be <br />paid to the Contractor on account of the Contractor providing the service. <br />2.
