store shall feature high quality interior finishes, superior to those in a typical Safeway <br />or Lucky, with a name that conveys a high quality, independent owner. Agency <br />approval is required to assignment of the lease to a new owner or operator. If the <br />grocery store tenant closes, the Developer may replace the tenant subject to the <br />Agency's approval. The new occupant(s) must occupy the space formerly occupied <br />by the grocery store tenant and must be an anchor tenant of the quality <br />commensurate with the high quality architecture, site plan, and other approved <br />tenants of the Center. <br />b) A Walgreen's Drugstore. The drugstore shall not be open 24 hours and <br />shall not sell alcoholic beverages. A 24-hour pharmacy drive -through is permitted. <br />Any store hour modification to the above shall be approved by Agency. <br />c) Fine Dining Restaurant. Crogan's Restaurant or one of similar quality <br />approved by the Agency, to be located bordering the creek, with view windows and <br />outdoor dining overlooking the creek, as presented to the City Council on June 30, <br />1997. The restaurant shall be 4,000 - 6,000 square feet, and Improvement Costs <br />(shell and tenant improvements) shall be a minimum of $150 per square foot. <br />d) Other Restaurants. The Project shall include at least one other <br />restaurant, preferably two, to be approved by the Agency. <br />e) Video Store. The Project may include a video store of approximately <br />6500 square feet to bring foot traffic to the grocery store, restaurants, and other uses, <br />as well as to enhance nighttime security. <br />f) Other Shops. The Project shall include other retail shops of <br />approximately 500 to 6,000 square feet that provide local services. The Developer <br />shall seek products and services that are not already found in great quantity in the <br />downtown. The Agency does not object to the following tenants: High -Tech Burrito, <br />Frame-n-Lens, Jamba Juice. <br />g) Second Floor Professional Services. The Project may include up to 6000 <br />square feet of second floor professional services space. Up to six tenants is acceptable <br />on top of the "Major C" tenant. <br />3. Architecture and Site Development <br />a) Architectural Quality. The architecture shall be of very high quality as <br />exemplified by drawings by MCG presented to the City Council on June 30, 1997, <br />2 <br />
