(5) Eight (8) statutory holidays (or the equivalent) each year plus paid <br />vacations of between forty (40) and one hundred sixty (160) hours annually, depending upon <br />length of employment service; <br />(6) Paid sick leave equivalent to between twenty-four (24) and forty-eight (48) <br />hours each year, depending upon length of employment service; and <br />(7) Public transit passes, where employer -paid incentive programs are <br />available from transit agencies at reasonable cost to Tenant. <br />Tenant will, once each year, provide Landlord with a statement, certified by Tenant's <br />president, managing member or chief financial officer, showing the actual Compensation <br />schedules in effect for employees of the Facility, as well as those for employees of other <br />conference centers and hotels operated by Tenant, or its Affiliate, which statement will explain, <br />in reasonable detail, the basis for any variances based on relative cost of living factors. <br />ARTICLE VII <br />REPAIR AND MAINTENANCE <br />Section 7.1 Repairs and Maintenance <br />As partial consideration for Landlord's entering into this Lease and causing to be <br />constructed the Public Improvements, Tenant covenants and agrees, throughout the Term, <br />without cost to Landlord, to maintain and repair (and to replace, as necessary) the Premises, the <br />Public Areas and the Improvements, and every part thereof (including both the Facility <br />Improvements and the Public Improvements whether located within or outside of the Premises), <br />and to keep the same in good order, condition and repair consistent with the Standard of <br />LEASE BETWEEN CITY OF SAN LEANDRO <br />AND SAN FRANCISCO BAY CONFERENCE RESORT <br />002574.0001\409817.4 <br />PAGE 36 <br />
