5. The pedestrian gate is not required by either the Fire or Building Code and thus <br />can be closed permanently. <br />In conclusion, the Planning Commission Staff Report recommends that the vehicle exit <br />with a sliding gate onto Harold Avenue remain; that the pedestrian gate be closed; that the <br />current circulation pattern on the complex lot be maintained; and that the tire spikes be removed. <br />On July 2, 1996, the City of San Leandro Development Services Department posted <br />notice of a hearing on July 11, 1996 by the Planning Commission to "consider revocation or <br />modification to site development subcommission approval granted in 1975, to permit vehicle and <br />pedestrian access to Harold Avenue from the St. Moritz Apartments at 14744 Washington <br />Avenue." <br />During the Planning Commission's public hearing on the matter on July 11, 1996, the <br />Commission considered the findings of the July 5th Staff report and heard testimony. The <br />testimony, detailed infra, may be summarized as follows: <br />Residents of Harold Avenue continue to feel that the combination of vehicular and <br />pedestrian access to the complex via Harold Avenue creates problems of noise; impacted on - <br />street parking; loitering; speeding and increased volume of traffic; litter from both pedestrians <br />and cars; and increased pedestrian traffic. Residents also asserted that there was an increase in <br />illicit activity attributable to the pedestrians using the gate into the complex. <br />Mr. Sullivan maintains that now as in 1975, vehicular access onto Harold Avenue is <br />necessary to provide safe exit from the complex. He also asserts that from 1977 until February <br />1996, he received no complaints from the residents of Harold Avenue or other neighbors of the <br />G: V OANN VSMORnZW SFINDG. C C <br />
