m <br />gateway, through the downtown Washington Plaza Shopping Center, and ending at an enhanced <br />regional AC Transit stop on East 14th Street. <br />WHEREAS, MTC requires a resolution stating the following: <br />1. the commitment of necessary local matching funds of at least 11.5%; and <br />2. the sponsor understands that the federal funding through the TLC program is fixed <br />at the programmed amount, and therefore any cost increase cannot be expected to <br />be funded through the TLC program; and <br />3. the assurance of the sponsor to complete the project as described in the <br />application, and if approved, as programmed in MTC's (TIP); and <br />4. the assurance of the sponsor to comply with MTC's project review process <br />pertaining to project management, design review at 30%, 60%, 90%, and 100% <br />phases, before and after photos; project delivery; and public events; and <br />5. the sponsor understands that funds must be obligated by September 30, 2004 for <br />TLC capital projects, or the project may be removed from the program; and <br />6. the sponsor understands that MTC expects the project to be constructed and <br />operational by September 30, 2005. <br />NOW, THEREFORE, BE IT RESOLVED THAT THE CITY OF SAN LEANDRO <br />proceed with the federal -aid process with Caltrans for TLC funding in the amount of S1,000,000 <br />for the West Estudillo/Historic Downtown Improvement project; and <br />BE IT FURTHER RESOLVED that the City of San Leandro, by adopting this resolution <br />hereby states that: <br />1. the City of San Leandro will provide $700,000 in local matching funds; and <br />
