1. Mrs. Be :ourt will have the rig, first refusal to <br />purchase the property described in Exhibit A after the house <br />currently located on 1242 Wayne Avenue, San Leandro, has <br />been relocated to 1103 Gardner Boulevard (said property). <br />This right shall be exercised within twenty (20) days after <br />notice by the City to Mrs. Bettencourt that the said <br />property and the house are available for inspection and that <br />the terms specified in paragraphs 2, 5, 6 and 7 below have <br />been completed. Mrs. Bettencourt shall inform the City in <br />writing of her intention to exercise the right to purchase <br />the said property within twenty (20) days after notice by <br />the City. Upon receipt by the City of Mrs. Bettencourt's <br />notice to purchase, City and Mrs. Bettencourt shall <br />enter into a purchase agreement. The purchase price <br />shall be One Hundred Six Thousand Dollars ($106,000). The <br />right to re -purchase is not assignable and may not be <br />transferred by testacy or intestacy, except that the right <br />to repurchase may be transferred by testacy or intestacy to <br />Dennis Bettencourt. <br />2. The City will reconstruct the floor in the family - <br />room of the house currently on 1242 Wayne Avenue, San <br />Leandro, over new floor joists and subflooring to match the <br />existing house floor level. The City will give Mrs. <br />Bettencourt a credit in the amount of One Thousand <br />Three Hundred Dollars ($1,300) against the purchase price of <br />One Hundred and Six Thousand Dollars ($106,000) for the <br />San Leandro/Bettencourt Agreement <br />9/11/85 <br />Page 2 <br />
