Chapter 3.16 <br />RELOCATION OF PERSONS AND <br />BUSINESSES DISPLACED BY THE <br />PROJECT <br />Sections: <br />3.16.010 <br />General. <br />3.16.020 <br />Relocation plan. <br />3.16.030 <br />Assistance in finding <br />other locations. <br />3.16.040 <br />Displaced persons of low <br />and moderate income. <br />3.16.050 <br />Relocation payments. <br />3.16.010 General. <br />The agency shall establish relocation rules <br />to guide assistance and payments to by project <br />persons and businesses displaced activities. <br />The rules shall comply with the requirements <br />of the relocation assistance and real property <br />acquisition guidelines adopted by the <br />California Department of Housing and <br />Community Development (Cal. Code Regs., <br />title 25, Section 6000 et seq.) (the "state <br />guidelines"). Such rules shall include a <br />feasible method for relocating persons to be <br />displaced from housing in the project area. <br />The agency may use funds derived from any <br />public or private source to carry out the <br />purposes of this chapter. <br />The agency shall establish a grievance <br />procedure for persons or businesses that are <br />dissatisfied with the relocation assistance or <br />payments provided. (Ord. 99-025 § 208.1. <br />1999) <br />3.16.020 Relocation plan. <br />Before proceeding with any activity that <br />will displace more than fifteen (15) residents <br />3.16.010 <br />or five businesses, the agency shall prepare a <br />relocation plan and submit it to the city <br />council for approval. The relocation plan shall <br />include the information required in Section <br />6038 of the state guidelines and shall be <br />consistent with the housing element of the <br />city's general plan. The agency shall provide <br />public notice of the relocation plan and make <br />copies of such plan available upon request. <br />(Ord. 99-025 § 208.2, 1999) <br />3.16.030 Assistance in finding other <br />locations. <br />The agency shall provide assistance to <br />persons and businesses displaced by project <br />area activities in locating suitable replacement <br />property. The assistance to be provided is <br />described in the agency's relocation rules, <br />which shall be made available to individuals <br />and businesses at least ninety (90) days before <br />they are scheduled to be displaced. If there is <br />any conflict between the agency's rules and <br />the state guidelines, the state guidelines shall <br />control. <br />No eligible person shall be required to <br />move from his or her dwelling unless within a <br />reasonable period of time prior to <br />displacement comparable replacement <br />dwellings or, in the case of a temporary move, <br />adequate replacement dwellings are available <br />to such person. Such replacement dwellings <br />shall be made available in the city of San <br />Leandro if the eligible person requests.
