incorporated herein, contemporaneously with the execution of this Agreement. 9.
<br />All of the terms and conditions contained in this Agreement are binding on
<br />and inure to the benefit of the parties, heirs, legal representatives, successors and
<br />assigns.
<br />10. Peluso, on behalf of himself and herself, his and her heirs, legal
<br />representatives, successors and assigns, hereby release the City and its officers, agents,
<br />employees, legal representatives, successors and assigns, from all claims, demands and
<br />causes of action, present or future, known or unknown, which Peluso had, has, or may
<br />have against the City of San Leandro, its officers, agents, employees, legal
<br />representatives, successors and assigns, arising out of the Lease, or the Forbearance
<br />Agreement.
<br />11. The City and its officers, agents, employees, legal representatives,
<br />successors and assigns hereby release Peluso, his and her heirs, legal representatives,
<br />successors and assigns from all claims, demands and causes of action, present and
<br />future, known or unknown, which the City had, has, or may have against Peluso, his
<br />and her heirs, legal representatives, successors, and assigns, arising out of the Lease, or
<br />the Forbearance Agreement.
<br />12. Notwithstanding the aforementioned releases in paragraphs 10 and 11
<br />above, nothing herein or aforementioned shall act to release the parties of their
<br />respective obligations or remedies under this Agreement to Terminate Lease, Assign
<br />Rights and Quitclaim in the event of breach or default.
