5. Amendments. Operation of the proposed use and construction of the project shall <br />remain in substantial compliance with the approved exhibits and plans. Minor <br />changes to the project design, shall be subject to the review and approval of the <br />Community Development Director. No application for amendment of the application <br />or Conditions of Approval may be accepted or submitted for processing by the City <br />unless (i) there is full compliance with all terms of the application and Conditions of <br />Approval; or (ii) the Community Development Director waives compliance with the <br />terms of the application and Conditions of Approval pending application for the <br />amendment. <br />REQUIRED ON -SITE IMPROVEMENTS <br />6. Prior to issuance of a business license or building permit for the proposed use, the <br />applicant shall obtain written clearance from the Alameda County Fire Department <br />and the Building Division indicating that conditions of occupancy have been met. <br />This condition may also be met by obtaining a Certificate of Occupancy. <br />7. Remove Barbed Wire. Prior to issuance of a business license or building permit, <br />the applicant shall remove barbed wire from fences visible from the right-of-way and <br />provide clear, color, and labeled photographs to the Planning Division, showing that <br />this has been completed. <br />8. Remove Chain Link Fence. Prior to issuance of a business license or building <br />permit, the applicant shall remove the chain link fences and gates visible from the <br />right-of-way and provide clear, color, and labeled photographs to the Planning <br />Division, showing that this has been completed. The gate may be replaced with a <br />gate made of wood or tubular steel, pursuant to Zoning Code section 4.04.364. <br />9. Exterior Improvements. Prior to issuance of a business license for the proposed <br />use, the applicant shall make the following exterior improvements: <br />a. The exterior walls of the building shall be painted, and any chipped paint shall <br />be resurfaced as needed. <br />b. Should the awning be removed, the wall behind the awning shall be repaired, <br />resurfaced, or repainted to match the surrounding wall. <br />BUILDING & SAFETY DIVISION REQUIREMENTS <br />10. Building Permits. The proposed project shall comply with all Applicable Code and <br />City ordinances, policies and regulations. The applicant shall obtain all necessary <br />building permits prior to construction of the project. and include the following in their <br />submittal(s): <br />11.
