This program shall include identification of <br />protected wildlife and habitats, a description of the regulatory status, and review of measures being <br />implemented to reduce impacts to special‐status species. Each worker shall be given a handout with <br />key points. At the end of the training, all workers shall sign a form to document their participation in <br />the program and understanding of the measures. <br />Temporary Exclusion Fencing <br />Prior to ground disturbance, exclusion fencing shall be installed around the entire portion of the <br />treatment wetland work area to exclude salt marsh wandering shrew and other wildlife species from <br />entering the area. The fence shall be made of a material that does not allow shrews and other <br />wildlife to pass through or over and the bottom shall be buried to a depth of 2 inches so that shrew <br />cannot crawl under the fence except in situations where burial of the fence would significantly <br />affect other species. <br />After the fencing is installed, all ground vegetation within the fenced area shall be cleared. <br />Construction work shall start as soon as possible (and no longer than one week) after vegetation has <br />been cleared. All exclusion measures and initial ground disturbance activities shall be monitored by <br />a qualified biologist as outlined above. Any soil/debris build up behind the fence shall be promptly <br />removed and any undermined areas or breaches shall be repaired immediately. <br />Biological Monitoring <br />At least 15 days prior to the onset of work activities, the applicant shall submit the name(s) and <br />credentials of the biologist(s) proposed to serve as biological monitor(s) for the proposed project to <br />the U.S. Fish and Wildlife Service (USFWS), NMFS, and/or CDFW. A qualified biologist shall be on site <br />during the initial vegetation clearing/grubbing and the installation of the exclusion fencing and to <br />confirm that avoidance measures have been implemented. The qualified biologist shall <br />communicate with construction personnel and have authority to make sure all mitigation measures <br />are properly implemented. The biologist shall also have the authority to stop project activities if <br />there is a risk of impacts to any special‐status species. If the biologist stops work, CDFW, USFWS, <br />and/or NMFS will be contacted by telephone within 24 hours. <br />If the outfall needs to be replaced/retrofitted and a cofferdam is needed, a qualified biologist shall <br />be present to monitor and approve the installation of temporary exclusion fencing and cofferdam, <br />as well as other avoidance measures. The biologist shall be present during all initial vegetation <br />clearing and in‐water work at the tidal slough. <br />Once exclusion fencing and cofferdam have been erected and all work activity is confined to the <br />work site, the biologist may be absent as long as no construction activities occur outside of the work <br />site. The biologist shall visit the site as needed to ensure the exclusion fencing and cofferdam are <br />properly maintained and working. The biologist shall have authority to halt the project, if necessary. <br />The biologist shall document all work by completing monitoring forms and preparing a summary <br />report that shall be retained for potential submittal to USFWS, NMFS, and/or CDFW and other <br />regulatory agencies as necessary, pending any permit requirements.
