<br />4/17/20 (P:\TER2001\BA\Special‐Status Species Biological Resources Habitat Assessment 4‐17‐20 .docx) 8 <br />PERMITTING <br />Depending if the existing outfall is replaced, retrofitted, or maintained (i.e., sediment removal), a <br />U.S. Army Corps of Engineers Nationwide Permit and Regional Water Quality Control Board Water <br />Quality Certification may be required for the project. Fish and Game Code section 1602 applies to <br />any river, lake, or stream, including those that are perennial, intermittent, or ephemeral. The <br />existing storage basin would not fall under the jurisdiction of CDFW since it is not a lake or stream <br />that is connected to a water body that falls under the jurisdiction of CDFW. Rather, the storage basin <br />is constructed, and actively used and maintained as part of the WPCP. The existing outfall and the <br />tidal slough would not fall under the jurisdiction of CDFW because the slough is a tidal feature that is <br />part of the San Francisco Bay, which is not a river, lake, or stream.
