3. Environmental Checklist <br /> <br />San Leandro Treatment Wetland <br />IS/MND <br />3-66 February 2024 <br /> <br />photographs, suggests that intact cultural resources are unlikely to exist in the Project area. <br />Historically an intertidal marsh, aerial photos from 1946 and 1958 depict the present pond area as <br />submerged, indicating it is now primarily disturbed fill sediment. <br />Based on the results of correspondence with the NAHC and the NWIC records search, no known tribal <br />cultural resources listed or determined eligible for listing in the California Register or included in a <br />local register of historical resources as defined in PRC Section 5020.1(k), pursuant to PRC Section <br />21074(a)(1), would be impacted by the Project. <br />However, if any previously unrecorded archaeological resource were identified during ground- <br />disturbing construction activities and were found to qualify as a tribal cultural resource pursuant to <br />PRC Section 21074(a)(1) (determined to be eligible for listing in the California Register or in a local <br />register of historical resources), any impacts to the resource resulting from the Project could be <br />potentially significant. Any potential significant impacts would be reduced to a less than significant <br />level by implementing Mitigation Measure CR-1 (Inadvertent Discovery of Cultural Resources; refer to <br />the Section 3.5, Cultural Resources) and CR-2 (Inadvertent Discovery of Human Remains). <br />Impact Designation: Less than Significant with Mitigation <br />b) Impacts to tribal resources. Based on the results of correspondence with the NAHC and the NWIC <br />records search, the City did not determine any resource that could potentially be affected by the <br />Project to be a tribal cultural resource significant pursuant to criteria set forth in PRC Section <br />5024.1(c). Therefore, the Project is not anticipated to affect any such resources. <br />However, if any previously unrecorded archaeological resource were identified during project <br />implementation, particularly ground-disturbing construction activities, and were found to qualify as a <br />tribal cultural resource pursuant to PRC Section 21074(a)(2) (determined by the lead agency to be <br />significant pursuant to criteria set forth in PRC Section 5024.1[c]), any impacts to the resource <br />resulting from the Project could be potentially significant. Any potential significant impacts would be <br />reduced to a less than significant level by implementing Mitigation Measure CR-1 (Inadvertent <br />Discovery of Cultural Resources; refer to the Section 3.5, Cultural Resources) and CR-2 (Inadvertent <br />Discovery of Human Remains). <br />Impact Designation: Less than Significant with Mitigation <br />Cumulative Impacts on Tribal Resources <br />The geographic scope for cumulative effects on tribal cultural resources includes the immediate vicinity of <br />locations where the Project could cause disturbance to known tribal cultural resources. Since the Project is not <br />anticipated to impact known tribal cultural resources, there is no expected cumulative impact in this regard. <br />However, it is possible that the Proposed Project and other cumulative projects in the vicinity might impact <br />previously undiscovered archaeological resources, including human remains outside formal cemeteries, during <br />ground-disturbing activities. These resources could be considered tribal cultural resources. <br />To address this, Mitigation Measures CR-1 and CR-2 have been established. These measures mandate halting <br />work near any discovered resources until they are assessed by a Secretary of the Interior-qualified <br />archaeologist and, in the case of human remains, notifying the County Coroner.
