Consulting Services Agreement between City of San Leandro and Exhibit A <br />GPA Consulting for Environmental Services for Lake Chabot Road Erosion Repairs Page 4 of 11 <br /> <br />In the event that traffic grinding, cold planing, or sandblasting are used to remove thermoplastic striping <br />material as part of the roadway repair, these analytics can be used to assess if the waste material <br />exceeds hazardous waste limits. <br />• Sample collection procedures and analytical results will be included in the ISA report. Analytical results <br />will be compared to hazardous waste limits, and recommendations for additional sample collection and <br />analysis, as warranted. <br /> <br />Task 3.4 Deliverables: Included in the Draft and Final ISA Report <br /> <br />Task 3.5: Cultural Resources <br />• Cultural resources documents required for Section 106 of the National Historic Preservation Act (NHPA) <br />will be prepared in compliance with all applicable requirements, and in a format acceptable to Caltrans <br />(Area of Potential Effects (APE) Map, Archaeological Survey Report (ASR) and Historic Property Survey <br />Report (HPSR)). <br />• A 1-mile radius records search will be completed from available data at the Northwest Information Center, <br />located at Sonoma State University. Information on historic built environment resources will be gathered <br />to prepare an Area of Potential Effects (APE) map. <br />• After the background research is completed and upon Caltrans approval of the APE, a systematic <br />pedestrian field survey of the Project will be conducted. The purpose of the survey is to identify any <br />cultural (historic or prehistoric) resources that may be impacted by the project, characterize the setting of <br />the project, and to field check any previously recorded cultural resources within or immediately adjacent to <br />the project discovered by the records search. <br />• In addition, the Native American Heritage Commission (NAHC) will be contacted. The NAHC will perform <br />a Sacred Lands file search and provide a list of Native American groups to contact regarding this project. <br />• Letters will be prepared on City letterhead to initiate the Section 106 consultation process; the letters will <br />be reviewed by the City and Caltrans prior to mailing. <br />• An ASR will be prepared that will include a project description, a natural and cultural setting section, <br />methods, results, archaeological sensitivity analysis, impacts analysis, and recommendations for further <br />work, if necessary. <br />• The HPSR will then be prepared, the umbrella document that Caltrans uses for compliance with Section <br />106. This document includes a summary of the records search, Native American consultation, and <br />Section 106 findings. The ASR and APE Map will be attached to it as supporting documentation. <br />• Based on anticipated negative findings, a short-form HPSR will be prepared. <br /> <br />Task 3.5 Deliverables: One electronic copy of the Draft and Final HPSR (includes APE, ASR, and <br />Section 106 consultation) <br /> <br />Task 3.6: Section 4(f) De Minimis <br />• Chabot Park, owned by the East Bay Municipal Utilities District and operated by the City is directly <br />adjacent to the project area. The park is a publicly owned, publicly accessible recreational facility and is <br />considered a Section 4(f) property under the Section 4(f) of the Department of Transportation Act of 1966. <br />As defined in 23 CFR Section 771.235(p), the “use” of a protected Section 4(f) resource occurs when: <br />land is permanently incorporated into a transportation facility through partial or full acquisition (“direct <br />use”), there is a temporary occupancy of land that is adverse in terms of the preservationist purposes of <br />Section 4(f) (“temporary use”), or the proximity of a transportation facility results in impacts so severe (i.e., <br />noise, vibration, visual, access, and/or ecological impacts) that the protected activities, features, or <br />attributes that qualify a resource for protection under Section 4(f) are substantially impaired (“constructive <br />use”). <br />Docusign Envelope ID: 78E72B1A-FA71-4376-9F02-D7D222FBE69F
