If Contractor identifies Unpermitted Waste delivered to the 742 Approved Facility(ies) by Collection Contractor or other Person(s), Contractor may reject the 743 Unpermitted Waste and require the Person(s) bringing such Unpermitted Waste to the Approved 744 Facility(ies) to remove it. The cost of removal and proper handling and Disposal shall be the 745 responsibility of such Person(s) delivering Unpermitted Waste. Contractor shall also be entitled to 746 pursue whatever remedies, if any, it may have against Person(s) bringing that Unpermitted Waste 747 to the Approved Facility(ies). 748 Should Contractor inadvertently Accept in a lawful manner Unpermitted Waste, Contractor shall 749 bear all responsibility for handling, Transporting, and Processing or Disposing of such material in 750 accordance with Applicable Law, unless the Person(s) bringing the Unpermitted Waste can be 751 identified, in which case the cost of removal and proper handling and disposal shall be chargeable 752 to such identified Person(s). Contractor shall be solely responsible for making arrangements for the 753 final Disposition of Accepted Unpermitted Waste and all costs thereof except as provided above. In 754 no event shall the City be responsible for making arrangements for the handling of Accepted 755 Unpermitted Waste or the costs thereof. 756 C. Notification. If the Contractor rejects Unpermitted Waste delivered by the Collection Contractor, 757 Contractor shall immediately notify the City verbally and then follow verbal notifications with a 758 written notice identifying the date and time of occurrence, material type, material weight or 759 volume, characterization of material, the Contractor’s reason for rejection of the delivered material, 760 photographs of the material, and the identification number or information of the vehicle that 761 Delivered the material. 762 D. Quarantined Waste. If approved by the City Contract Manager, Contractor may Dispose of, rather 763 than Process, specific types of Organic Materials that are subject to quarantine and that meet the 764 requirements described in 14 CCR Section 18984.13(d), for a period of time specified by the City 765 Contract Manager or until the City provides notice that the quarantine has been removed. In 766 accordance with Exhibit D, the Contractor shall maintain records and submit reports regarding 767 compliance agreements for quarantined Organic Materials that are Disposed of pursuant to this 768 subsection. 769 5.2.3 Prohibited Container Contaminants Monitoring 770 A. General. Contractor shall actively work with the Collection Contractor throughout the Term of this 771 Agreement to monitor the levels of Prohibited Container Contaminants in City Delivered Materials 772 at the Approved Facility(ies). Contractor shall inform Collection Contractor of specific days and/or 773 loads that contain high levels of Prohibited Container Contaminants, the type of Prohibited 774 Container Contaminants most frequently found in City Delivered Materials, and any other related 775 information that may be useful for the Collection Contractor in identifying the types of Prohibited 776 Container Contaminants and developing strategies to reduce contamination and to target 777 information in the Collection Contractor’s education and outreach efforts to Generators. 778 Contractor shall Accept all City Delivered Materials that contain Prohibited Container 779 Contaminant levels equal to or less than the following: (i) Residential Organic Materials and 780 Commingled food waste and yard waste: three percent (3%), (ii) Source Separated Food Scraps: 781 twenty percent (20%.). In the event that such vehicle load delivered by Collection Contractor 782 exceeds such Prohibited Container Contaminant thresholds, Contractor may reject the load in 783 accordance with the load rejection procedures outlined in Section 5.2.2.
