<br />July 15, 2024 Page 14 City of San Leandro/ACI Franchise Agreement <br />B. Consolidation of Containers. Contractor shall evaluate the need for and provide Containers as 504 <br />necessary for the aggregation of material removed from event Collection stations during the course 505 <br />of the event. Contractor shall provide Containers in sufficient number of appropriate type(s) for the 506 <br />needs of the event (which shall include consideration of needs of the vendors for discarded packing 507 <br />materials) as determined by Contractor in cooperation with the event organizer. Contractor shall 508 <br />provide for the service of such Containers, as agreed-upon with the event organizer, and deliver 509 <br />Collected materials to the appropriate Designated Facility for Processing and/or Disposal. 510 <br />C. Public Education. Upon request of either the City Contract Manager or the event organizer, 511 <br />Contractor shall provide educational resources and/or engagement opportunities for the event 512 <br />attendees to inform them about the services and programs provided by Contractor under this 513 <br />Agreement and the benefits of Source Reduction, reuse, Recycling, and Composting. 514 <br />D. Reporting. Within thirty (30) calendar days of the end of the event (unless otherwise requested by 515 <br />City on an event-by-event basis), Contractor shall submit a report to the City Contract Manager and 516 <br />event organizer. The report should include, at a minimum: the number of event Collection stations 517 <br />deployed at the event, the Tonnage of each material type (i.e., Recyclable Materials, Organic 518 <br />Materials, and Solid Waste) Collected, and a description of the public education provided at the 519 <br />event. 520 <br />Contractor may, at its sole discretion and expense, coordinate with event sponsors, local youth, 521 <br />community, or charitable organizations to provide some or all of the required services. Regardless of 522 <br />Contractor’s use of such an organization, Contractor shall be responsible for ensuring that service is 523 <br />provided to the Customer in a professional and timely manner. 524 <br />In addition to the six (6) City-designated events specific in this section, Contractor shall provide Discarded 525 <br />Materials Collection Service for the City’s farmer’s markets in accordance with Exhibit B4.6. For special 526 <br />events that are not identified in Exhibit B5, Exhibit B4.6, or otherwise hosted or sponsored by the City, 527 <br />Contractor shall provide the above-described special event services at the request of the event organizer 528 <br />and may negotiate the charges for such services with the event organizer based on the specific needs of 529 <br />the event. 530 <br />4.9 PUBLIC LITTER CONTAINERS 531 <br />Contractor shall Collect Solid Waste from the Public Litter Container locations identified in Exhibit L, and 532 <br />as may be added in the future. Contractor shall be responsible for ongoing purchase, inventory 533 <br />management, installation, ongoing maintenance, and periodic replacement of Public Litter Containers 534 <br />throughout the Term of this Agreement. Weekly services shall include Collecting and Disposing of the 535 <br />contents of each Public Litter Container, sweeping of the site including clean-up of litter within a radius of 536 <br />five (5) feet of each Public Litter Container, and response, within one (1) Working day of notification, to 537 <br />Complaints regarding overflowing Containers. Frequency and days of Collection shall be designated by the 538 <br />City, with a minimum Collection schedule of Monday, Wednesday, and Friday for each Public Litter 539 <br />Container, and may be more frequent if requested by City. Contractor shall within two (2) Working days 540 <br />of identification of damaged Public Litter Containers, and/or notification by City of a damaged Public Litter 541 <br />Container, arrange to have the Container fixed or replaced. 542 <br />Contractor shall make reasonable effort to identify Generators who may be illegally dumping Discarded 543 <br />Materials into Public Litter Containers.
