<br />July 15, 2024 Page 15 City of San Leandro/ACI Franchise Agreement <br />Container that has four (4) or more instances of overflow that appear to be due to illegal dumping within 545 <br />any one-month period; (ii) for any such Public Litter Container with repeated overflows due to illegal 546 <br />dumping, inspect materials for identifying Generator information such as a name or service address; (iii) 547 <br />report to the City any identifying Generator information; and, (iv) assist the City as requested in 548 <br />investigating any instances of overflow due to illegal dumping. Records and information pertaining to (i), 549 <br />(ii), and (iii) shall not be disclosed by City or Contractor except in accordance with applicable law. 550 <br />Contractor shall include information regarding the status of Public Litter Container Collection in its 551 <br />quarterly reporting as provided in Exhibit D, including but not limited to: (i) number of Public Litter 552 <br />Containers in service and in inventory; (ii) number and location of Public Litter Containers replaced in the 553 <br />previous month; (iii) number of Public Litter Containers that received maintenance in the previous month; 554 <br />(iv) locations at which Public Litter Containers tend to overflow and may need an increased frequency of 555 <br />Collection; and, (v) status of any ongoing or pending abandoned waste investigations including the 556 <br />location of the Public Litter Containers and the steps Contractor is taking to address the problem. 557 <br />If so directed by the City Contract Manager, Contractor shall purchase and use Public Litter Containers to 558 <br />separately Collect Source Separated Recyclable Materials and/or Source Separated Organic Materials. In 559 <br />this event, Contractor shall not commingle such materials with Solid Waste during Collection and shall 560 <br />Transport all such materials to the appropriate Designated Facility for Processing. 561 <br />4.10 PUBLIC EDUCATION AND OUTREACH 562 <br />The public education and outreach activities included in the scope of services provided by Contractor 563 <br />under this Agreement are described in Exhibit C. As further described in Exhibit C, Contractor shall prepare 564 <br />and distribute public education and outreach materials. 565 <br />A. Program Objectives. Contractor’s public education and outreach strategy shall focus on improving 566 <br />Customer understanding of the benefits of and opportunities for Source Reduction, reuse, 567 <br />Recycling, and Composting. In general, Contractor-provided public education and outreach should: 568 <br />(i) inform Customers about the services that are provided under this Agreement with specific focus 569 <br />on describing the methods and benefits of Source Reduction, reuse, Recycling, and Composting; (ii) 570 <br />instruct Customers on the proper method for placing materials in Containers for Collection and 571 <br />setting Containers out for Collection with specific focus on minimizing contamination of Recyclable 572 <br />and Organic Materials; (iii) clearly define Excluded Waste and educate Customers about the hazards 573 <br />of such materials and their opportunities for proper handling; (iv) discourage Customers from 574 <br />buying products if the product and its packaging are not readily reusable, Recyclable, or 575 <br />Compostable; (v) encourage Customers to recover Edible Food for consumption by humans or 576 <br />animals; (vi) encourage the use of Compost; (vii) encourage use of drought tolerant landscaping that 577 <br />generates less plant trimmings; (viii) encourage Customers to purchase products and packaging 578 <br />made with Recycled content materials; and, (ix) educate Customers on any other topic as required 579 <br />by SB 1383. 580 <br />B. Coordination with City Educational Efforts. Contractor acknowledges that they are part of a multi-581 <br />party effort to operate and educate the public about the regional integrated waste management 582 <br />system.
