<br /> <br />Non-Professional Services Agreement between City of San Leandro and March 1, 2025 <br />Micki’s Towing Inc. — Exhibit A Page 4 of 11 <br /> <br /> <br />Exceptions: <br /> <br />1) When a release request is made within the first "hour of storage", the storage fee shall be waived. <br /> <br />2) When a release request is made within 24 hours, only one day's storage shall be charged regardless <br />of the calendar date. <br /> <br />3) When the vehicle is stored as evidence (22655.5 of the California Vehicle Code), the storage fee <br />shall be waived up until the time the hold is released by police. <br />O. LIEN ON STORED VEHICLES <br />The SLPD personnel who is requesting the impound shall be responsible for establishing that "probable <br />cause" exists to impound the vehicle in question. When "probable cause" is lost prior to a vehicle being <br />removed to a Contractor facility, no lien shall be attached, and no fee shall be charged for the field release <br />of a vehicle to a properly interested person. <br />P. TRAFFIC ACCIDENT SCENE CLEANUP <br />At the request of the SLPD, the Contractor shall dispatch a tow unit to the scene of a traffic accident and <br />shall remove all glass, liquids and other debris deposited upon the roadway as identified in Attachment 1, <br />Exhibit A, 5(a) through 5(d). <br />Q. TOXIC MATERIALS <br />City will not knowingly require the Contractor to pick up, store or dispose of any toxic or hazardous materials, <br />except for those normal fluids associated with motor vehicles. <br />R. LICENSES, CERTIFICATES AND PERMITS <br />As of the submission date of the proposal, a Proposer shall hold and maintain in good standing throughout <br />the term of the Non-Professional Services Agreement and any extension term all State and county licenses, <br />certificates and permits required to perform the types of services contemplated under this RFP and the Non- <br />Professional Services Agreement. As of the effective date of the Non -Professional Services Agreement, a <br />Contractor and all its drivers performing on the Contractor's behalf under the Non -Professional Services <br />Agreement shall procure and maintain in good standing throughout the term of the Non-Professional Services <br />Agreement any extension term, all City of San Leandro licenses and permits requested under the San <br />Leandro Municipal Code and all drivers shall maintain appropriate valid driver licenses issued by the State <br />of California. In addition, the Contractor shall keep informed of and comply with the requirements of all <br />Federal, State, county and municipal laws, ordinances, and regulations applicable to the work performed <br />under the Non-Professional Services Agreement. <br />S. BACKGROUND INVESTIGATION <br />Prior to the award of the Non-Professional Services Agreement, the SLPD shall conduct or have conducted <br />a background investigation of the business, its principals, and its tow truck drivers. The Contractor awarded <br />the Non-Professional Services Agreement shall be responsible to notify the SLPD whenever a new driver is <br />assigned to tow requests from SLPD.
