Introduction <br /> <br />Environmental Impact Report 1-7 <br />Commenter Comment/Request Summary <br />Where the Topic is Discussed in <br />the EIR <br />East Bay Municipal <br />Utility District <br />The East Bay Municipal Utility District will not design <br />piping or services until soil and groundwater quality <br />data and remediation plans have been received and <br />reviewed and will not start underground work until <br />remediation has been carried out and documentation of <br />the effectiveness of the remediation has been received <br />and reviewed. If no soil or groundwater quality data <br />exists, or the information supplied by the project <br />sponsor is insufficient, East Bay Municipal Utility District <br />may require the project sponsor to perform sampling <br />and analysis to characterize the soil and groundwater <br />that may be encountered during excavation, or East Bay <br />Municipal Utility District may perform such sampling <br />and analysis at the project sponsor's expense. If <br />evidence of contamination is discovered during East Bay <br />Municipal Utility District work on the project site, work <br />may be suspended until such contamination is <br />adequately characterized and remediated to East Bay <br />Municipal Utility District standards. <br />Potential impacts of the project <br />associated with hazardous <br />materials, including contaminated <br />soil and groundwater, are <br />evaluated in Section 4.2, Hazards <br />and Hazardous Materials. <br />East Bay Municipal <br />Utility District <br />East Bay Municipal Utility District requests that the City <br />include in its conditions of approval a requirement that <br />the project sponsor comply with Assembly Bill 325, <br />"Model Water Efficient Landscape Ordinance," (Division <br />2, Title 23, California Code of Regulations, Chapter 2.7, <br />Sections 490 through 495). The project sponsor should <br />be aware that Section 31 of East Bay Municipal Utility <br />District’s Water Service Regulations requires that water <br />service shall not be furnished for new or expanded <br />service unless all the applicable water-efficiency <br />measures described in the regulation are installed at <br />the project sponsor's expense. <br />This comment cites regulatory <br />requirements. The proposed <br />project must comply with <br />regulatory requirements regardless <br />of CEQA analysis and mitigation <br />measures. <br />Native American <br />Heritage Commission <br />The Native American Heritage Commission <br />recommends consultation with California Native <br />American tribes that are traditionally and culturally <br />affiliated with the geographic area of the proposed <br />project as early as possible in order to avoid inadvertent <br />discoveries of Native American human remains and best <br />protect tribal cultural resources. <br />No California Native American <br />Tribes have submitted requests to <br />the City of San Leandro for <br />consultation on CEQA projects <br />pursuant to Public Resources Code <br />Section 21080.3.1. The proposed <br />project does not involve an <br />amendment to the City’s General <br />Plan; therefore, consultation <br />pursuant to SB 18 is not required. <br />Potential project impacts related to <br />tribal cultural resources are <br />evaluated in the Initial Study, <br />which is provided as Appendix A to <br />the EIR. The Initial Study also <br />provides mitigation measures to <br />reduce potential impacts to tribal <br />cultural resources. These <br />mitigation measures also appear in <br />the Executive Summary of this EIR.
