SUMMARY AND RECOMMENDATION Staff recommends adoption of a Resolution summarily vacating a portion of the public right -of- way on Fairway Drive (at 2500 Merced Street). BACKGROUND Sandis Engineering, on behalf of Kaiser Permanente LLC, owner of 2500 Merced Street, has requested that the City vacate a portion of public right -of -way on Fairway Drive (at 2500 Merced Street) as shown on the attached Exhibit A to accommodate the proposed Kaiser San Leandro Medical Center. The area to be vacated is a triangular area approximately 141.3 square feet. Kaiser owns the parcel that abuts the area to be vacated. The State of California Streets and Highways Code sets the authority and procedures for street, highway, and easement summary vacation. The procedure for summary vacation is outlined in Part 3, Division 9 of the Streets and Highways Code. Per Chapter 4 of Part 3, Division 9, Section 8334 of the Streets and Highways Code, the legislative body of the local agency may summarily vacate a portion of public right -of -way if there is an excess of right -of -way of a street or highway not required for street or highway purposes. Analysis Fairway Drive is an arterial roadway through the city that includes a bridge over the 1 -880 freeway. A one -way frontage road between Miller Street and 1 -880 runs along on either side of the bridge to access the rear of 2500 Merced (the Kaiser parcel) and 1700 Fairway (currently
