Cooke, Principal Engi~eer <br />SUBJECT PROJECT/PROJECT DESCRIPTI N: <br />MATTER OF SUMMARILY VACATING THE EMERGENCY VEHICLE ACCESS <br />EASEMENT ON LOT 4 OF TRACT 7382, 1300 BUSINESS CENTER DRIVE, SAN <br />LEANDRO, A PORTION OF ASSESSOR'S PARCEL NO. 079A-0591-011, AND <br />ACCEPTING A NEW EMERGENCY VEHICLE ACCESS EASEMENT ACROSS LOT 4 <br />AND LOT 5 OF TRACT 7382, 1300 BUSINESS CENTER DRIVE, SAN LEANDRO, <br />PORTIONS OF ASSESSOR'S PARCEL NOS. 079A-0591-011 AND 079A-0591-006 <br />SUMMARY AND RECOMMENDATION <br />Staff has prepared a resolution to summarily vacate the Emergency Vehicle Access Easement <br />(EVAE) running along the easterly and southerly boundaries on Lot 4 of Tract 7382, 1300 <br />Business Center Drive, a portion of Assessor's Parcel No. (APN) 079A-0591-011. A second <br />resolution proposes to accept a new EVAE spanning Lot 4 and Lot 5 of Tract 7382, 1300 <br />Business Center Drive, APN 079A-0591-011 and 079A-0591-006. Staff reviewed the matter <br />and determined that once the new easement is established, the current easement will not be <br />needed for present or prospective emergency vehicle access purposes. Therefore, staff <br />recommends adoption of the resolutions summarily vacating said easement and accepting the <br />new EVAE. <br />BACKGROUND <br />Lot 4 and Lot 5 (located to the west of Lot 4) were originally planned for separate ownership and <br />development at the time Tract Map 7382 for the Bayside Business Center was recorded. These <br />parcels have since been purchased by 400 High Street LLC, who plans to construct a National <br />Construction Rentals facility on the lots. However, the proposed site layout conflicts with the <br />existing EVAE. Therefore, the existing EVAE, which was established when Tract 7382 was <br />created, will be replaced with an EVAE that better accommodates future development at this <br />location and will span both Lots 4 and 5 as shown on Tract Map 7382. <br />Analysis <br />Jo ~ Jermanis <br />Ci Manager <br />The summary vacation process, which requires at least one resolution and no public hearing, is <br />more cost effective than the longer but more commonly used vacating procedure.
