Cooke, Principal Engineer <br />SUBJECT PROJECT/PROJECT DESCRIPTION: <br />APPROVED AND <br />FORWARDED <br />TO CITY COUNCIL <br />Jo Jermanis <br />C' ~ anager <br />MATTER OF SUMMARILY VACATING PORTIONS OF THE EMERGENCY VEHICLE <br />ACCESS EASEMENT, INGRESS AND EGRESS EASEMENT, AND PUBLIC UTILITY <br />EASEMENT ACROSS NEW LOT 8 OF TRACT 7382, 1400 BUSINESS CENTER DRIVE, <br />SAN LEANDRO, ASSESSOR'S PARCEL NO. 079A-0591-015, AND ACCEPTING AN <br />EMERGENCY VEHICLE ACCESS EASEMENT, INGRESS AND EGRESS EASEMENT, <br />AND PUBLIC UTILITY EASEMENT ACROSS NEW LOT 7, NEW LOT 8, AND NEW <br />PARCEL A OF TRACT 7382, NO ADDRESS, ASSESSOR'S PARCEL NOS. 079A-0591-007, <br />079A-0591-014, AND 079A-0591-015 <br />SUMMARY AND RECOMMENDATION <br />Staff has prepared a resolution to summarily vacate portions of the Emergency Vehicle Access <br />Easement (EVAE), Ingress and Egress Easement (IEE), and Public Utility Easement (PUE) <br />across new Lot 8 (LLA 2007-261221) of Tract 7382, 1400 Business Center Drive, San Leandro, <br />Assessor's Parcel No. 079A-0591-015. A second resolution proposes to accept new easements <br />for emergency vehicle access, ingress and egress, and public utilities across new Lot 7, new Lot <br />8, and new Parcel A (LLA 2007-261221) of Tract 7382, no address, Assessor's Parcel Nos. <br />079A-0591-007, 079A-0591-014, and 079A-0591-015. Staff reviewed the matter and <br />determined that once the new easements are established, the current easements will not be <br />needed for the purposes for which they were created, and new easements will be dedicated to <br />replace those to be abandoned. Therefore, staff recommends adoption of these resolutions. <br />BACKGROUND <br />In June of 2003, Tract Map 7382 was recorded for the creation of Bayside Business Park, an <br />environmentally sensitive business park located near the west end of Davis Street. FedEx <br />Ground was the first company to move in to this new subdivision, occupying the southernmost <br />parcel, approximately 6.30 acres, known as Lot 8 of Tract 7382. <br />In March of 2007, FedEx Ground applied for a permit (BLD2007-00580) for two building <br />additions to its facilities. In July 2007, the cul-de-sac at the southern end of Business Center <br />Drive was relocated with the recordation of a lot line adjustment (Instrument No. 2007-261221, <br />Alameda County Official Records). The lot line adjustment moved the cul-de-sac to the north to <br />accommodate the expansion of the parking lot. As a result, portions of the public easements <br />
