Hollister <br />Interim City Manager <br />MATTER OF BANNING USE OF ALCOHOL IN CITY PARK AND OPEN SPACE AREAS <br />SUMMARY AND RECOMMENDATION <br />Staff recommends that the City Council adopt an ordinance and a resolution to amend provisions <br />in the San Leandro Municipal Code and the San Leandro Administrative Code to ban alcohol use <br />in City park and open space areas with an exception for City-sponsored events which have <br />received prior approval from the City Council. <br />BACKGROUND <br />After discussion at the December 1, 2008 meeting, the City Council passed to print Ordinance <br />No. 2008-016, amending Chapter 4-1, Article 7 of the San Leandro Municipal Code to ban <br />alcohol use in City park and open space areas except for City-sponsored events with prior <br />approval from the City Council. <br />Analysis <br />This recommendation is a result of meetings and discussions held at Recreation and Park <br />Commission meetings over the past five months, including having met with representatives from <br />Best Manor Homeowners' Association, Farrelly Pond Neighborhood Association; discussions <br />with other Homeowner's Association members; discussions with the San Leandro Police, Public <br />Works and Recreation and Human Services Departments, and review of parks policies and <br />ordinances of other cities. <br />Chapter 4-1, Article 7 of the San Leandro Municipal Code regulates alcoholic beverages in <br />certain public places and is silent on alcohol in parks. The proposed Ordinance No. 2008-016 <br />amends the Article to: <br />• Define alcoholic beverage to "mean and include alcohol, spirits, liquor, wine, beer, and <br />every liquid or solid containing alcohol, spirits, wine or beer that contains one-half of one <br />percent (0.5%) or more of alcohol by volume and which is fit for beverage purposes <br />alone or when diluted, mixed or combined with other substances." <br />• Provide the regulation that "no person shall consume or be in possession of any open <br />container of any alcoholic beverage in any City park or open space area, except for City <br />sponsored events with prior approval from the City Council." <br />
