• • <br /> IN THE REDEVELOPMENT AGENCY <br /> OF THE CITY OF SAN LEANDRO <br /> RESOLUTION NO. 2000 - 25 (2888) <br /> RESOLUTION OF THE SAN LEANDRO REDEVELOPMENT <br /> AGENCY OF THE CITY OF SAN LEANDRO APPROVING REUSE <br /> REPORT REQUIRED BY HEALTH & SAFETY CODE § 33433 AND THE <br /> AMENDED AND RESTATED DISPOSITION AND DEVELOPMENT <br /> AGREEMENT (DDA) BETWEEN CREEKSIDE ASSOCIATES, LLC, <br /> AND THE SAN LEANDRO REDEVELOPMENT AGENCY FOR THE <br /> SALE OF PROPERTY TO BE DEVELOPED AS CREEKSIDE <br /> BUSINESS PARK, LOCATED AT 960 SAN LEANDRO <br /> BOULEVARD, IN THE PLAZA REDEVELOPMENT PROJECT AREA, <br /> APN 75- 36 -52, TO ADD A THIRD BUILDING, BUILDING C (50,000 <br /> SQUARE FEET) AND A ONE -LEVEL PARKING STRUCTURE <br /> RECITALS <br /> WHEREAS, the Redevelopment Agency of the City of San Leandro ( "Agency ") entered <br /> into a Disposition and Development Agreement (the "February Agreement ") with Creekside <br /> Associates, LLC ( "Creekside "), pursuant to Agency authorization given following the conduct of <br /> a joint public hearing of the Agency and the City Council on February 22, 2000 (the "February <br /> Approval Date "); <br /> WHEREAS, subsequent to the February Approval Date, Creekside has proposed to the <br /> Agency that the February Agreement be replaced or cancelled and that the parties instead enter <br /> into an agreement entitled "Amended and Restated Disposition and Development Agreement" <br /> submitted herewith (the "Agreement "). In connection with that request, Creekside has submitted <br /> a development concept plan (the "Development Concept Plan ") for the development of the <br /> "Property" (which is that certain property described in Exhibit "A" to the Agreement), including <br /> certain amenities to adjacent City property along the creek, which Development Concept Plan is <br /> attached as Exhibit "B" to the Agreement. The Development Concept Plan provides for a <br /> different and more intense development of the Property than that which had been provided for <br /> under the February Agreement, and which shall specifically include a parking structure as more <br /> particularly described in the Agreement; <br /> WHEREAS, the Agreement provides for the disposition by the Agency to Creekside the <br /> property at 960 San Leandro Boulevard (the "Property') a purchase price of Two Million Seven <br /> Hundred Sixty Three Thousand Four Hundred Twenty One Dollars ($2,763,421) (the "Purchase <br /> Price ") and additional consideration under the terms of the Agreement; <br /> WHEREAS, the Agreement provides for the development of three (3) high- quality office <br /> buildings with an improved plaza area, a parking structure, creekside improvements, and <br /> DOC SOC \730475 v 1 12423 8.0001 <br />
