ORIGINAL <br /> AMENDMENT NO. 1 <br /> TO SEWER SERVICE CHARGE BILLING AND COLLECTION AGREEMENT OF <br /> DECEMBER 27,2002, <br /> BY AND BETWEEN <br /> EAST BAY MUNICIPAL UTILITY DISTRICT <br /> AND <br /> CITY OF SAN LEANDRO WATER POLLUTION CONTROL PLANT <br /> THIS AMENDMENT, dated the 13th of November, 2012 (hereinafter the"AMENDMENT") <br /> amends the Agreement dated December 27, 2002 for billing and collection of sewer charges <br /> (hereinafter the"AGREEMENT"),by and between the EAST BAY MUNICIPAL UTILITY <br /> DISTRICT(hereinafter the"District"), a public entity, and the CITY OF SAN LEANDRO <br /> WATER POLLUTION CONTROL PLANT (hereinafter"the Agency"), a public corporation. <br /> WITNESSETH <br /> WHEREAS District's Board of Directors adopted Motion 196-02 on December 10, 2002 <br /> authorizing the AGREEMENT for billing and collection of sewer charges; and <br /> WHEREAS on December 27,2002,the Agency and District(collectively,the"PARTIES") <br /> entered into the AGREEMENT for billing and collection of sewer charges; and <br /> WHEREAS the PARTIES wish to amend paragraph 1.06—Termination Of Agreement in the <br /> AGREEMENT to extend the term of the original AGREEMENT by six months from December <br /> 27, 2012 to June 30, 2013, and to provide for six-months written notice before implementing a <br /> new rate tier calculation for the Agency's prorated share of the Customer Information System <br /> replacement cost; and <br /> WHEREAS all other provisions of the AGREEMENT remain unchanged and in full force and <br /> effect. <br /> NOW, THEREFORE,the PARTIES do agree as follows: <br /> 1 <br />
