continue collection of any one of the above items, the Contractor may petition the City <br />Representative for approval to discontinue collection of those items as Recyclables or dispose of <br />those collected items. The City is under no obligation to grant such petition. Where the City <br />requests an increase in the items collected which affects the operational costs of the Contractor, <br />the Contractor and the City Representative shall negotiate an appropriate adjustment in the Rates <br />paid th the Contractor for that limited purpose and to insure a fair and reasonable rate of return to <br />the Contractor. <br />B. Frequency of Collection. The Contractor shall collect Recyclable Materials within the City on a <br />bi-weekly basis or more frequently as may be determined between the Customer and the <br />Contractor to prevent Containers from becoming overloaded. Where mutual agreement is not <br />reached, the City Representative shall determine frequency. <br />C. Hours of Collection. Collection shall begin no earlier than 6:00 a.m. and shall cease no later <br />than 4:00 p.m, Monday through Friday; provided however in the event of an emergency or <br />unforeseen circumstances, collection may be permitted at a time not allowed by this paragraph <br />provided the Contractor has received prior written approval by the City Representative. No <br />Collection shall occur on Saturdays, Sundays or Holidays except in a time of emergency, missed <br />pickup, or to maintain a regular schedule due to Holidays recognized by the Contractor. Special <br />pickups may be requested by Customers at additional cost which shall be billed by the Contractor. <br />D. Point of Pickup. Multi-Family Residence Customers shall accumulate Recyclable Materials at <br />locations which are mutually agreed upon by the Customer and the Contractor. Where mutual <br />agreement is not reached, the City Representative shall designate the location(s). <br />E. Receptacles. Multi-Family Residence Customers will utilize Recyclable Materials Carts or <br />Containers specifcally provided for Recycling. The Contractor shall maintain an adequate supply <br />of replacement Carts for Recyclable Materials specifically provided for Recycling, to provide for <br />new Multi-Family Residences or to reasonably replace those lost, stolen, broken or faded. <br />F. Revenues Generated from Rec clables. Revenues generated from the sale of Recyclable <br />Materials shall be retained by Contractor. <br />4.9 COMMERCIAL SOLID WASTE AND RECYCLABLE MATERIALS COLLECTION SERVICES <br />AND DISPOSAL <br />A. Sc_ ooe. The Contractor shall have the exclusive right to collect, transfer, Recycle, process and <br />dispose of all Solid Waste and Recyclable Materials from all Commercial Customers within the <br />City, except as excluded under the Franchise. <br />B. Frequency of Collection. The Contractor shall collect Solid Waste from Commercial <br />establishments a minimum of one (1) time each week or more frequently as may be determined <br />between the Contractor and each individual Commercial establishment to prevent Containers from <br />r:~..~a~~~~wz.~.Pa ovovoo Page 21 of 59 <br />
